Well they are also shouting about Nurse shortage just like Corporate America is shouting about shortage of H1Bs.
Actually there is also a severe shortage of Doctors in US. However
unlike "American Academy of Nursing" where medical industry
has strong influence. AMA is for doctors but they lobby for doctors and not
the medical industry and time and again they have acted to:
1) reduced the medical procedures that nurses can do for their own selfish interests
2) deliberatly crafted the residecy rules to make it very hard for foreign doctors to get licensed in US.
3) AMA has a kind of alliance with another very powerful lobby
(pharma Lobby)
AMA (doctors) in turn says that imported drugs from canada are unsafe.
In turn pharma lobby backs the AMA lobby interests.
So what can IV work realistically:
Work against any increase of H1B or try to reduce it.
Work against EB visa grap by Schedule A
They only IV will be heard. Unless you set their houses(vested interests)
on fire then only you will be heard.

independence. In World War 1 they gave a false promise of independence if Indian National Congress (INC)
cooperated. Eventually with the non cooperation movement, the idea of keeping India as a colony became
fiancially unviable. Also britian was broke due to the 2 world wars.

But I am afraid when we cannot stand united on this group- with only 200-400 or so of the 9000 contributing, I am not even sure what kind of Non Cooperation will work here.

Ofcourse everyone is very excited that the priority dates are current but let's take a careful look for why it became current all of a sudden even when the demand for visa numbers is so high and was backlogged by 5 years up until couple of months ago.
1. I sincerely feel this is just to keep the legal immigrants to stop protesting for benefits in the CIR. Well, the CIR is supposed to be dead right? Wrong, count 2 weeks from now and the Bill will be back with tons of benefits for Illegal aliens and none for legals.
2. Currently Service centers are processing cases received in Aug-Sept. '06 with the few thousands of applications being submitted for the next few weeks the processing dates will be moved back by couple of years. All this time we were waiting for the priority dates and now will wait for the processing dates to be advanced. What a circus!!!
3. Just when the case is ready for processing that would be atleast couple of years from now, the priority dates will be retrogressed may be by 10 years this time.
To my knoweledge we should still continue to lobby the senators and get the Visa numbers increased, get the country quota eliminated, Only one visa should be counted per family... and get it into the CIR. Should the CIR pass without these ammendments legal immigrants will be stuck in limbo for every because there will be no more CIRs in the near future.

My advanced parole is good till October 2, 2009. I have been in and out US 2 times, spent 2 months abroad doing finals in college. Am going to intern abroad, until October 28th.
Q1: What is the best date to reenter the US and renew advanced parole? Do I need to be in the US to renew AP?
Q2: How long do I need to stay in US after sending in my renewal? Do I need to wait the 3 months to get the new parole?

AP renewal took only 2 weeks, and actually the approval date is only one week from date of receipt notice, i actually lost about a month from my previous approval. This is at NSC

Whatever he used last to enter US, in this case F1(class of admission will be mentioned in the i-94 stamping
Which I-94 copy should be attached, the one that was stamped when he last entered US, or the latest I-94 he received from his last H1 filing?
I would attach both copies to be on safer side and avoid any RFE's,however i have never sent i-94 copies. Please take a look at my blog for list of documents/cover letter for AP. Hope you find it useful

I agree, India is a far better option.
Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.
On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.
You do realise that one of the biggest reasons for India's rapid growth is it's population right? It is both a boon and a curse. And if you "enforce" a one child policy, there will be a rapid decline in population. There will be major social problems, what happens to a couple if their only child dies in teenage?. Apart from obvious social issues (kids will have fewer cousins and fewer relatives), the biggest problems will arise in 30 years when the severely depleted young populace will have to support the huge number of retired old workers either directly through parental support or indirectly through taxes.
Think of your old age too, these solutions look interesting, but it will kill the very reasons that make India attractive today.
A gradual stabilization of population by encouraging families to have just two children through social programs is the way to go and I think India has done a good job of it in the last 2-3 decades. These things take time.
And before you quote China's "significant progress", 25 years later, they are going through a lot of issues. For example, take a look at this http://www.nytimes.com/2009/07/25/world/asia/25shanghai.html

When exactly did you submit your application? I just called a few minutes ago to ask about mine (which was submitted early May) and the guy said I should not be affected by this as I should already be well into "the process by now" meaning I should have already been assigned a visa. He spoke very very slow...so I don't know if he was 100% sure of what he was saying:confused:

The problem is, that for all my efforts, people just don't seem to care. The only reason I had any success was the embarrassment I caused the government because of all the soldiers who were excluded. Immigrants in the US are viewed by most people as an unwanted scourge.
My employer has also been no help at all. I have been looking for work outside of the US, but unfortunately, the economic situation makes that a bit more challenging. Sorry if I sound pessimistic. That is just my personal experience.
I agree with you, immigrants (legal or illegal) will always be viewed inferior in this country and we will always be immigrants. I am not sure if I want this tag with me, my kids, their kids all their lives. Sometimes I wonder if this GC path is even worth it. Going through so much trouble every time there is renewal, there is stamping, stamping delays, so much scrutiny, no certainity of coming back once you visit home country, so much even after living here for 6 years and now this back log.
If you read any news on immigrants and read comment section after it, you will realize the hate from people here in this country. Is it really worth it to live in this country, when people here do not want to accept us? No acceptance in community, such high crime. Yes sure there will be some exceptions along the way who will rise to top.
Just to point out the difference the amount of celebration among blacks after Obama won. Was there such kind of celebration after Sonia won or Manmohan became PM from their communities? This shows the kind of differences people have. I am not saying things in India are great, or else I would not be here. Just wondering on my random thoughts if its even worth it.

Because of unlimited H1b entire bill may be voted down if taken for consideration. It will be big surprise if any bill passes with unlimited H1b or GC in any category.
I don't understand the risk you are mentioning. How unlimited H1B is going to cause problem in eliminating retrogression in EB catagories?

I don't know how to start a new post so place here....
I was working on a H1B.
Husband - who is the premary person applied for Green card. When his priority date was current he applied for I-485 for both of us.
After getting my EAD I started working on EAD for 1 month and got the paystubs for past one month. Now looking for new job.
Which status Am I - H1B or EAD...:confused:
Now If I am on EAD can I take a break for 3 months before the next job offer.

Once you start working on EAD you are no more on H1B. Your future employer can apply for H1B for you. Your previous H1B is automatically 'abandoned' as you used EAD

Piyushpan, you are restating what I said and putting in extra things. All 3 categories need an immigrant petition. The advanced STEM degree + 3 years people need "special labor cert" if their grad degrees are not from the US. Please re-read what I wrote earlier.
Are you STEM exempt? if so, is your advanced degree from the US? If yes, you may not need labor cert. But remember, I am not an expert. Get a lawyer's advice.

1 People who have advanced degrees and are presently working can apply for adjustment of status(I-485) even if they don;t have a labor or a pending I-140 but they will be subject to quota to get the final approval.
2Secondly for people who are presently studying and doing their MS they can directly apply for I-485 if they have a US job offer within one year after graduation but they will be subject to quota as well
3Thirdly there is the category which has MS/Phd and 3 yrs of related exp.
For this category they can directly apply for I-485 and no quota issues either.
My question is for all these 3 categories can you really directly apply for I-140 and I485 concurrently or do you have to have a certified labor certification or pending I-140 at the time of enact ment of the bill.
I am asking because i have an approved perm labor and I-140 and waiting to file for I-485..but my company is not doing well so i may have to restart the process all over again in the new company i join.But if i have to file only I-140 and I-485 to get the GC in new company and if this bill becomes law then that would be amazing as i don;t have to go through the labor cert process anymore..

As the bill stands today, you are correct and unfortunately that will do more harm than any help. so we all should try to eliminate this potential trouble
what does this mean ?
assuming 290000 seats passed of which 35 % is EB3 .. would make it 101500 seats.. if country restriction is 10% then it would mean just 10150.. is my understanding correct. . ?

Yesterday I received my approved EAD card in 25 days from date of application (paper filing) from TSC
