    I and my wife got our approved EADs in our hand in 17 days (Mailing day to USCIS to recevied date by us). Only strange thing is that my EAD is valid from 06/2008 to 06/2009. I thought the new EADs validity would begin when the existing expires. My existing EAD expires on 09/19/2008. I lost 3 months with this renewal.

    USCIS has been unfair in renewing EAD.

    What about writing a letter to them? - by grace of God, if they do realize, they may give properly - for 2 years.

    Nothing wrong in trying.

    Hi,

    Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.

    My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).

    Given all this, I have following questions.
    a). Are there any risks associated with filing AP.
    b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
    c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?

    Appreciate any help/pointers on this.

    No risk associated with filing AP at all

    You did not have to inform any official agency but she should have filed an I9 form (i think thats the form) when she used EAD for work

    You cannot be on H4 and EAD either or

    EB3 porting is a loophole like labor substitution.

    when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.

    Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.


    How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

    Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

    I was in Indian consulate for renewing the passport. I went there on time and there was a pathetic guy at the entrance who refuse to speak other than hindi. Though I told him that I do not understand hindi, he never listen to that and started his conversation with hindi.
    Then comes the worst part. A cab driver went to him and handed over some dollar note and got the token. Then the driver handed over the token to the passenger and left. That guy got into the line well before me and got his work done. @#$K those people.

Yes, I used to work for Fragomen, before anyone wants to assume anything. I was a paralegal and worked hard for every case that was given into my hands. I specialized in the green card process and made sure I responded to every foreign national as quickly as I can. Please understand that paralegals and legal assistants are subject to the attorneys they work for. Therefore, some questions you may ask require an attorney to respond, and the paralegal or legal assistant's delay may be in trying to get the answer you require. I know not all Fragomen offices work the same. Not all will respond to you in the same manner. Some may be worse than others. So if you are going to defame Fragomen, would you please try to specify which office you are referring to?

    I have read through all the posts on this thread and I know some of you have positive experiences, while others have had very negative experiences. To those of you who have had negative experiences, I am sorry that your case went to someone who only looked at their work as a job. For me, each one of my foreign nationals were special cases, each required as much care and concern that I could give them. None of my cases were ever denied. I wish you all the best in this process. I know it is a long and, many times, frustrating process, especially with countless delays due to either the law firm, your company, or the government.

    And for the person who had asked about the prevailing wage, it comes from the state employment department, not the federal government. Some offices work faster than others. When a prevailing wage comes back higher than what you are making, the law firm then has to go back to the employer to find a resolution, which can mean either an increase in the salary once you have received the green card, or confirmation that is what you will be making at that time, or a reduction in the requirements, which can sometimes take a case from EB2 to the EB3 visa category.

    LOL - they will set up a BEC for FOIA requests...

    Paying money for something that will give us results is fine (although I strongly feel this information should be free for whoever requests - that is the whole point of FOIA), but paying for something that has no commitment from USCIS to any date's is in my view throwing away money for their pizza parties or whatever else they do over there besides work.

    I got 2 year EAD from NSC in August 2008.

    Wanted to apply for Advance Parole (second time).

    Is NSC issuing 2 year AP's ?

    Wondering if any body got Advance Parole for 2 years from NSC.

    Also, I appreciate if any one can share their experince about INFOPASS to get Advance Parole in case of emergency

    (if one did not apply for AP & need to travel urgently).

    desi9333 thanks for the link. Nice one - even though it covers only Hiring practices, and not opportunities for promotions and progression.

    The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

    Its my view and others can differ. I respect all opinions and am thankful to all because it helps improve my reasoning, mutual respect and tolerance abilities.

    Back to the subject,
    My earlier post on first page this thread has some action items - can anyone here take the lead and convince an attorney to take up the cause?
    My cheque shall be sent as soon as the ball gets rolling.

    BTW, The National Inquirer, who were the first to break the story of John Edwards affair has released the Plain story as well. I am not saying that this is real story or a false rumor. I am merely saying that this is out there and the fact is, John Edwards also denied the story in the beginning.     Hi i feel your pain. I think you should look into writ of mandamus which people having been filing for FBI name check issues(i am one of the victim). You will need support of employer since this is employer's petition.

    Hey, thanks for the support. Please talk to anyone who know has been affected personally. Please spread the word. I with few other people will talk to a lawyer soon on this to get things initiated.

    But we will need enough support to gather a critical mass and start things rolling in the right track.

    What I meant to say, you�ll succeed if you have the capability (with your professional knowledge, experience and skills) in your professional filed but definitely not with USCIS.

    I can say, USCIS is a great leveler in this aspect. Everybody from PhD to Programmer is same in front of USCIS. All have to wait 10+ yrs with mental tension and anxiety, no matter what your caliber is and how successful you are in your profession.
    Don�t get me wrong here. I also had to suffer for visa stamping, renewals, I-94 issues, PA etc in US Visa processing (nothing sever though). At the 5th yr of H1-B, I just decided.. to hell with that.....
    I don't know about you guys, but, I would be heart patient with that kind of anxiety in another 5 yrs of GC process �. Really need a lion's heart to pursue US GC now days

    I agree, India is a far better option.

    Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.

    On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.

    As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

    Since this bill has EB based provisions and does not have controversial guest workers program, would it make more sense to support this bill if it were to be tabled on senate floor instead of Specter's bill? Especially since house is totally opposed to any bill which has a guest worker program.

    Moderators and those involved with IV's lobbying firm give it a thought as this bill will be less controversial than specter's.

    I just went through the number of members in the IV org. To my surprise I found 21,353 members. If atleast each of the member contribute atleast $5, we could easily hit above $100,000. But I am sure we all can contribute far more than $5.

    What a shame that the educated highly qualified H1B holders who haven't contributed anything so far don't get it. Come on guys/girls contribute in some way...come to the rally or sponsor someone if you can't make it or atleast contribute some money. You don't want to feel guilty all throughout your life thinking you were just a free-rider.

    Take advantage of this great opportunity, BECAUSE OPPORTUNITY LOST IS LOST FOREVER. IT SELDOM KNOCKS TWICE.
