I am new to the site and have been reading these posts and I have very little knowledge regarding the greencard processing. But as far as I know, law is not clear in this matter and this results in different interpretations by different people. There is also little scope for any law suit as the State Dept is the ultimate decision maker in these issues. see section 202 of INA Act
"(B) 1/ Nothing in this paragraph shall be construed to limit the authority of the Secretary of State to determine the procedures for the processing of immigrant visa applications or the locations where such applications will be processed"
Also it is not clearly explained if EB categories take preference or country limits have preference over EB categories. The State Department can clearly argue that EB2 is entitled for 28.6% of total EB visas and per country limit does not apply as EB2 category still has unused visas left for use this quarter and they intend to maximize the use of total EB2 visas available. I think we should all stop arguing(because in the end it will not change a thing) about who should get the first chance at Green card and pray for all those friends who have been waiting for years and sincerely hope that their wait ends soon. Instead we should concentrate on how we can help each other and see about how we can improve the process

I think the DOS now realizes that USCIS cannot effectively handle processing of the massive release of visa numbers in the last quarter, thereby they are doing it in an incremental manner so that the demand is handled effectively (USCIS standards effectively).

For AP documents, it says we can submit any document issued to you by USCIS showing your present status in US. Now, currently I am on H1B. So should I send them my I797 approval document or EAD copy? Also in there instructions they are asking to send copy of an official photo identity document showing your photo, name & DOB? Can it be PP/DL/EAD?
Your status will be shown buy copy of I485 receipt. AP requires the following:

Please stop posting such rude and derogatory posts for people stuck at BECs. It's very easy to criticize if you are in a better position than someone. But remember, you could also have been one among them. Then, if you were expressing your dissatisfaction and instead have people call you losers, you wouldn't begin to imagine how that feels. Now that it is clear that we can file 485 without 140 receipt notice, I want to know what you guys, who have not received 140 receipt notice yet, are planning to. Are you going to file 485 right now with the information insturcted by USCIS (brightly colored paper...)? Or are you going to wait for the 140 receipt notice until certain point and then, if you still have not received the receipt by then, file 485 with the information insturcted by USCIS (brightly colored paper...)?
I think we can wait till Aug 15th for I-140 receipt and if we don't get that (:( :mad: :confused: ) then we can file I-485 with the mailroom instructions from the FAQ (:) :) )

No you can't. You must have filed separately. You could have amended your return to file jointly, but not the other way around.

So, I can do it that way (file separately first and get stimulus and then amend the return to file jointly after I get stimulus) only for tax year 2008?
(IRS website also says if u do so, you dont have to return the stimulus benefit - unfortunately this clause was added only on 04/14/2008!! according to IRS website).

I also do not understand why H4 are not eligible for work permit. I think when they passed H1b, they did not lobby for H4's to have work permit as they probably did when they introduced L1/L2 and E1/E2 visas. The onus is on us H1b holders to ask for H4's to have work permit. So I hope IV adds this to their list of goals if it is not already one. Lot of people understand that current H1b limit is not enough so this could be a good option if they are reluctant to increase the H1b cap.

I think people should read the legislation completely and understand before they comment on the proposed system.
With the existing system people will wait for their turn , In the proposed new system the application gets trashed and one cannot apply for 3 more years if one can not make it in the year he or she applied.
What are the rules governing the new system when more people get highest score than the available green cards per country . It would be another lottery . This can not be a merit based system unless they remove country caps.

Transefered to new employer : Filed Ac 21,G 28 , H1 Transfered to new company through corporate lawyer
Even received EAD and AP renewals last week.
Today I have received deniel notices for me and my family applications.
Thank God I did not use my EAD so far.
Dont know what to do? It is so frustrating.
No NOID also , they sent deniel directly as your case.
Please post if you have received any updates.
