What happens if I get my EAD after 180 days of concurrent filing i-140 & i-485, and my employer no longer has a vacancy for me. Can I start at another job or do I have to refile the i-140. (I'm not presently working for the company yet)

It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

I had gone thru a layoff experience 3 years back.
They laid my team off in April, but for some reason said that they will keep us on payroll till July (effectively we got a paid holiday for 3 months :-) ) and gave us severance on top of that.
I took the 3 months to do job search and started the new job in July (technically there was a month gap between when I stopped being on payroll and when I started new job).
Recently when I asked old employer for employment verif letter for I140, the letter said I was employed till July of 04.
In general my feeling is, as long as you have paystubs and employment verif letters that you can use to claim you were employed till a certain date, you should be ok.
How much of a grace period on top of that USCIS gives is a hard qn to answer (just like anything else related to USCIS) ?

All who are on H4 visa ,is there a way out that we all can write an email or letter to the USCIS or the law changing authority to change the H4 law and get right to work ,I mean one nicely drafted mail or Letter with all the problems highlighted and the disadvantages which the spouse and the H4 are facing .I am mentioning some points which we can write
1.H4 cannot work any where in the USA,not even for an hour
2.Green card is years away.
3.Just be at home and keep on asking money from your spouse for everything you need.
4.With the 65000 quote every one on H4 cannot get an H1.
5.Every one on H4 is not necessary a computer professional or having a 4 year degree possible 3 year or may be less so they cannot qualify for an H1.

Why can't a H4 have a work authorization same as J2 or L2 or E2. Does ImmigrationVoice considered this thought and thinks as a good point to raise it to the senate in one of their efforts?

My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.

I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?

Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.
Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change
Anyway - lets close the thread. I was hoping to get some better information about how we can improve our motivation techniques for the future. I got many answers...

As far as I know, if one goes to UK on a work permit, the spouse can start working from the beginning itlsef. The professional and the spouse get their automatic PR in 4 years just by being there. There are similar examples in other countries, but, the fact is that if we have to be in the US, we have to go by "their rules".
I admire US administration's guts to openly admit and declare that they are biased and work on a case by case basis or at will when it comes to looking out for their own interests, even in the immigration (Not to mention, they look confused as well).
For example, how is a spouse of an L1 visa holder anyway different from a spouse of and H1 ? The difference is that the US government presents the L2 spouses with an EAD at arrival and restricts the H4 spouses to home.
Well, I think we should take one thing at a time, and the current task in hand at IV is more than enough to comprehend and fight for, adding the H4 issue eventually may add value, but not at this juncture.
