    My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....

    There are uglier things than sausages being made. For example, when Bernie Sanders gave a 30 minute speech to increase H1B fees and make H1B program useless, he brought a big chart and the whole enchilada to try to prove that H1B depresses wages.

    However, in the starting part of his speech, he said he supports the bill.

    The bill brings in 200,000 guest-workers each year (it was 400,000 before Bingaman amendment). However, according to him, that is just fine. When guest-workers come to US in numbers like 200,000 then they dont depress wages of the lowest income group in America. However, when hi-tech workers come here they depress wages.

    This is the kind of logic from people like Bernie Sanders and Co. that is uglier than watching sausages being made. Watching sausages being made might hurt your eyes, but this kind of logic hurts your head and can damage your brain's neurons.

    With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.

    I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.

    As the saying goes �the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.

    Don�t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that�s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.

    And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.

    Hi Dixie,

    I think that listing an absolute value does not provide an accurate picture. If you measure in terms of relative values, then you will see that immigration is important; it is a top 3 issue. However, let's not forget that there is a nasty war going on and sons and daughters of people are dying for - in my view - a war that makes no sense at all. That is serious and it has undeniably galvanized the attention of the public at this time.

    That said, from what I have been reading on talk radio shows, people are disappointed in general with the GOP - even with the pro amnesty position adopted by Pres. Bush, McCain, Specter, etc - and therefore want to give them a bad time. I don't think that was an endorsement for amnesty at all.

    Celebrate now. Amnesty for 20 million+ is coming and hopefully we can take a ride :-)

The perceived opposition to CIR was blown out of proportion by the conservatives and their media cronies like Lou Dobbs. That it did not work clearly shows that the american public too mature and sensible to be carried away by such rhetoric.

    Hi,
    1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.

    Here are my questions.

    1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?

    2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.

    3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.

    4. Another suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

    Hello guys,
    I had a strange issue with my wife previous H1-B.
    she came to US on H4 on 05.03.
    some x comapany processed her H1 and got approved on 10/1/2004
    and valid till 9/30/2007.
    on 1/2/2006 she change from x Company to y comapny and still working for y company.

    For applying for GC, i checked her online status for x comapny (old) in uscis site..found strange thing...her old employer did not receive any notice from INS...Please advise...

    USCIS does not work for you or me but sure you can go and ask them for prefiling AOS but not to issue RFE for same job requirement condition and other haressing rfe. how can you say we cannot ask USCIS not to raise RFE for irrelevant stuff,I guess you are ok with all the RFE that are being issued by USCIS on h1 holders currently.

    Hydboy I agree with your earlier statement about AC21 issues. However you have not shared any data. Also like I mentioned that it's always the ones who've had negative experience who'll be more vocal. I think Kiran has provided an excellent set of advantages, foremost being the ability to use AC21. It's also interesting to see you say the following :

    You and all the people who missed out on July fiasco obviously want to file AOS and get EAD at any cost (i understand and support that ) but what about us who have been here for 5 to 10 years and took us multiple years of wait to file AOS and get EAD. "

    This dilutes your arguments in my opinion. Anyway, let me provide you with a counter point. Assume for a moment that an administrative fix does come through for pre-applying AOS. This will cause an increase in 485 applications again and correspondingly more people using AC21. I believe that if there is a definite USCIS pattern to wrongly denying AC21 then with a large volume of people being disaffected by it, there will also be a bigger chance that it will fixed. So in the end this should be helpful to everyone and not just people who missed July 07. Please note though that this is a if, since we haven't seen any solid data yet to corroborate this.

    Hi All,

    Andrew Dutton - 917-536-5940, immigration_counselor@yahoo.com is my attorney for green card. I had also used him before for H1B renewal, PERM & I-140 substitution with DOL (while case was pending with Backlog Center). He is very professional, humble, and always answers phone calls & email messages immediately. He is also very very affordable (shall I say inexpensive - see the amounts he charged me for H1B, green card processing etc below).

    I was one of the unfortunate ones who got scammed my Earl David Associates (New York Law Firm) - now renamed to Jed David Philwin Associates. I know how bad law firms can be - they did not file my LC in 2003 but kept on telling me that they did - ONLY a year after in 2004 they promised me they had already done so. Needless to say how much pain suffering this caused me.

    I used Andrew for my H1B + wife's H4 renewal - total attorney fees - $550. No extra fees for filing documents for family members.
    Then, I used him for EB2 PERM, I-140, I-485/EAD/AP (for myself & my wife) - total attorney fees - $1600. No extra fees for filing documents for family members.

    I had an existing LC approved from Backlog Center - he filed I-140 for just $100-$150 attorney fees - stating that since he had already filed a previous I-140 for me - he just needs to modify some minor details on the I-140 & file it.

    He filed my I-485 over the weekend so it reached USCIS on Monday July 2 - who knows I may be one of the lucky ones when July visa bulletin fiasco is resolved.


    Regarding, Philwin associates they're big time scammers...they've taken from me $5000 without giving me not even a receipt or send me the retainment and dissapeared specifically avoid fake lawyer Michael (MIKE) Venieris. I'm personally taking them to court so spread the word. Does anyone know where submit a complaint for them to the IRS and the lawyers association? However, SPREAD THE WORD so at least to take them out of the market!!

    San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?



    I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.

    But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.

    If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.

    It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)



    There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.

    Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.

    With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?




    I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?

    We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?

    The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.

    IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.

    People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.

    We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.

    Have faith my friend...

    Dear Members,

    We are working hard to assist our members coming to DC for the advocacy days. Many members have been helped by local DC members by providing accommodation in their homes.

    We are trying very hard to manage the high expense of this event ranging from booking a conference room in a hotel near Capitol hill, printing and buying bulk media drives for each meeting, organizing a press event to Congressional reception expenses. Our budget is $50 thousand dollars for the entire event and we are struggling to meet this goal. Our minimum budget for these events is 50K budget. At this time we have received around $7,500 dollars as contribution from IV members, and we wholeheartedly Thank every who has contributed. But we need everyone to step up to the plate and do their fare share. We have a tough road ahead and we need every one to help for their ow cause. In the past IV Team had spent their personal resources to get the effort going and have our voices heard. We are all working hard to organize these events despite some of the core members already getting their Green card holders. It is now up to each member how valuable they view this effort and can stand up for themselves. Each one of us is participating this effort for own self rather than doing any favor to others or to IV. Please donate generously for this event so that we can make it a success..

    Some members have approached us seeking help in their tickets. We are not in a position to pay for travel or arrange buses for anyone. We would like to help them by starting this thread and urging other members to donate their skymiles to others that are coming.

    Please post on this thread if you are willing to donate your skymiles. An IV representative will keep a tab on all skymiles and connect both the donor and recipient after verifying that the recipient will be coming to Dc and using these skymiles only for the advocacy days for himself.

    We have a member from a state where we do not have many members and needs American Airlines miles. He would need more than 1 lakh miles. There are a few more in our list.

    So your analysis is: people are unhappy with GOP that “some” of them are in favor of immigration measures and punished them by giving control to a party where “most” of them are certain to support those same measures ????!!!???!!! Its most illogical and even comical analysis I ever heard.

    Elections show that American people are much smarter than some politicians/talk show/TV show hosts hoped for. True, elections are fought on much stronger issues like war, economy etc and exit polls have shows that people are not too concerned about illegal immigration issue despite of coverage given by likes of Lou Dobbs. Also based on the fate of candidates who made the immigration their main plank, it can be argued that majority is actually in favor of such measures…..election results are a lot complicated to say anything like that…..but….its a much more logical conclusion that what you were saying.

    You are reading my post selectively and not in its entirety. I did not say EAD is waste and useless, I said EAD is waste and useless without the removal of semilar or same job requirement in AC21 as USCIS will sooner or later deny AOS based on semilar\same job requirement. Do you know how many RFE\denial notices have been issued by USCIS to EAD\Ac21 workers? There is an entire thread running into several pages related to that. Scores of people wrote to USCIS ombudsman complaining about USCIS issuing denial notice to people whose I140 was revoked by previous employer even though Ac21 says AOS continues even if I140 is rovoked by previous employer. There are instances where USCIS has issued rfe to prove they are in a same\semilar job. History has shown USCIS uses issues like same\semilar job to kick people out. Based on the IO adjudicating your case, based on the economic climate etc USCIS has made life difficuly (current h1b crackdown is a example).

    What I am saying is bring in protection to AOS by
    -removing the same or semilar job requirement in AC21
    Its not that easy to make this adjustment. If you take out this clause a person can work any where and this is more like a green card. For example a software person can even work in a gas station. I am afraid, this cannot be done as easy as you think.--- Again, I am not saying that it should not be done; all I am saying is let us keep this as a separate item

    -making sure USCIS does not deny AOS when previous employer revokes aproved i140.(even though ac21 says aos cannot be denied, USCIS is sending denail notice).
    There were several request mails already sent to USCIS ombudsman about this issue. Let us not mix up again.


    Yes EAD is absolutely better than H1b but not for long, when people start using EAD instead of H1b, -- This issue will come only if I change my job. If I want to be with same employer I will have flexibility of using EAD (with out the need to extend H1, Visa Stamping)
    USCIS will start denying AOS based on Same\semilar job or other grey areas (not working on EAD because of lay off) then you are back to square one. If you are on EAD and AOS is denied you are out of status like H1b. -- This will come in to picture if I want to use AC21.
    Close the loopholes first before you open the pre filing AOS. Your statement regarding not work at all on EAD is not correct. USCIS can issue rfe\denial notice for lack of job. I hope it was true that it does not matter if you are not working at all on EAD.

    Also please remember that the percent of AC21 denials are compartively less when you compare with total number of people who successfully used AC21... we already have a separate compain for AC21 denials where lots of people have already sent mails CIS ombudsman.

    If I am wrong please correct me.

    chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining. Now it's only fair that you don't complain when people making additional sacrifice are given some recognition. Don't mistake...those donors also make all other forms of non-monetary contributions. Have patience things will work out slowly but surely.
