If anyone knows the history, this is pretty much happenned to Family based visas. 20 years ago, it was as easy as 1-2-3 and ppl use to get GCs in matter of months or 1-2 years. INS realized this and they started imposing processing dates and delays and what not and as it stands today, it takes about 10 years to get GC on family based.
They may have same plan in mind that instead of paying unemployment to PRs and Citizens, let's kick out the smart ppl who are stealing all the jobs and now their country is taking some of our businesses too.

I want to give u some hope as IV member .My 485 was denied april 18th and found out that it was because 140 was denied on april 21ist.i was thru hell as i didnt get denail notice till may 14th and i had only 4 days to file MTR.as IV seniour members told me ist cause of denail is CIS ERROR.
try to stay calm and wait for denail notice .after u know why they denied and how can u support ur MTR with supporting docs u dont need to change the attorny .MTR is simpl.U can figure out what u would need .
my 140 got approved july15th and 485 got reopened .

I totally get where you're coming from - I was in the same place also some time back. And I absolutely support dissenting voices - every organization needs a conscience. IV is no exception. So go ahead with your questions and ignore the folks trying to shut you up.
Heres why I contribute to IV -
IMHO the biggest role IV is playing right now is educating the media, politicians, administrators etc. about the hardships we're going through. The first step towards solving a problem is to get people to acknowledge there is one. And right now there are people in the administration who don't think or even know there is a problem.
Mark Bartosik's done some great work with the media. Nixtor has also been prominent here. I'm sure there are others also involved.

If some part of the contributions make life easier for these folks - its absolutely worth it, isn't it?
And for folks who refer to this as "Donation"
Its not a donation - its a contribution.
Donation refers to a gift to a charitable organization whereas a ontribution is generally associated with a gift to a common fund or collection.

Then there is a link about IV and FBI namechecks...The last update is some thread in Feb 08 and this brilliant statement from 2007 ..."IV has met officials from agencies and has raised this issue in the recent past. You really expect that you can convince people to contribute based on this flimsy evidence of doing "something" that you really cant tell us ??

Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.
I've noticed that it's hard to get someone who can sound like they are really sure of the information they're giving you. I wonder if they're reading from something or just guessing sometimes. i shouldn't have to use the internet to get my information, they should be the #1 information center, and they can't even do that.:(

Its very disappointing to me. My some of friends who filed labor just 2 months before me now will go citizenship for next year.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases. I believe when both center starts processing July cases then you can see significant movement in EB3 cases. I think you need to wait till September when new quota comes. Till that time as my Atorney says focus and save your Jobs. Get more skill. Without good job all above is meaning less. Busy yourself in NFL, NBA, NHL or Cricket be cool and calm. Nothing is in your hand except waiting.

GCBY3000, I think you are right. It is not all that simple. There are many in the House who can still vote against amnesties. We shall watch and see. I suggest that no one gets too excited about this.
SInce democrats gained the contorl on house, they will wait till the next congress starts to pass releif to immigration issue. THis way, they can take the credit for it and campaign it for their next election. Republicans are stuck now. They neither want to pass it nor want it to supress. They dont want the democrats to gain the credit whatsoever. If republicans cannot pass it this year they will do everything to stop it in next congress session if they have majority in senate. It is vey comlicated and sensitive issue and we have to wait to see how the business people push the lawmakers. None other then business tycoons can make some impact with this kind of power split in senate / congress with a lame duck president for next two years.

Do you really think the numbers will be that bad? Look at the improvement in turnout in DC from San Jose? ...
San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?
Do you think Indian’s in CA have a different mindset compared to those in TX or NY/NJ?
I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.
But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.
If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.
It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)
If rallies are local and on a weekend then more people will turn out. Not only will there be better turnout, many of these same people will being more passionate about their support to IV and might start showing up in out of state rallies and protests.
There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.
Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.
With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?
Many of my colleagues did not even know until yesterday when I showed then the news articles that there was a rally like this in DC. Unless we have local chapters with an organized structure which meet regularly/ even if it’s a conference call, you cannot expect mass mobilization…this is Politics works!!
I think the DC rally has caught every ones attention, this is the right time to push the drive for local mobilization, it will be tragic if we lose the momentum now.

What an absolutely useless discussion! EB2 and EB3 are based on each employer's attestation of job/work requirements.
Obviously, there is little correlation between book knowledge and real world results. Highly educated lawyers and Top B School MBA's can be found stuck in dead end jobs or suboptimal careers while barely educated street smart folks can be found enjoying productive careers.
So, let us stop this nonsensical analysis about something that adds ZERO value towards the core mission and objectives.
Lets use those 'high skilled' grey cells for something that matters. Stay away from the keyboard if you cannot resist the urge to puke over it with your fingers putting forth filth.

How can anyone explain this now? Isn't it a money scheme? Is it reasonable to loose 3 months when you had already paid for it? There is always confusion in this whole GC affair. There seems no option than to live with it and move forward.
People have told me that they lose 1-3 months during ead renewal as the EAD is valid from the date of approval. But I do have seen 1-2 posts where they said new EAD starts from the expiry of current. That is why it is confusing. I think the former is more prevalent (losing 1-3 months of ead in overlap).

I am not sure if it's that easy to figure out from wage level whether PERM Labor falls under EB2 or EB3 category as there are PERM with wage level IV and Job Title Welder (which I assume cannot fall under EB2 category) and besides that for Microsoft out of 1200 labor only 44 are under Level IV.
