Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

�And not only am I going to run against her, but I will beat her,� Sheehan added.
A spokesman for Pelosi, Nadeam Elshami, said the Speaker and House Democrats are working toward their goals this Congress and would not address Sheehan�s proclamation.
�The Speaker and House Democrats are focused on ending the war in Iraq, holding the Bush administration accountable and delivering a new direction for the American people,� Elshami said.�Those are the priorities of the Speaker and the Democrats.�

"The Democrats will not hold this administration accountable, so we have to hold the Democrats accountable," Sheehan said outside of Conyers' office after the meeting. "And I for one am going to step up to the plate and run against Nancy Pelosi."
Sheehan and about 200 other protesters had walked to Conyers' office from Arlington National Cemetery. She said Conyers told her there weren't enough votes for impeachment to move forward on the issue.
Forty-five of Sheehan's fellow protesters also were arrested. Capitol Police spokeswoman Sgt. Kimberly Schneider said that after they are processed, the arrested activists could each pay a $50 fine to be released.
"Impeachment is not a fringe movement, it is mandated in our Constitution. Nancy Pelosi had no authority to take it off the table," Sheehan told her group of orange-clad activists before they began their march from the national cemetery.

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.
If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

Folks,
I filed concurrently I 140 and I 485.
My application has been transferred from California to Nebraska.
I wanted to check if folks have seen any updates on thier cases.
I noticed on the website, for my I 140 status it does not show any date etc, it simply says case transferred to a USCIS office. For some folks it shows on a specific date..XX XXXX we recd your case at this office..
Can we all share our data under this thread for I 140 filing with 485 on July 2.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. However, when I analyzed their case, it quickly became apparent to me that nothing could be done to help them. It was too late. Well I stand corrected. Last night I reported that Rima Fakih was born in the US to immigrant parents. That's what the one biography I could find that listed her birth place actually said. But a day is a long time in the news cycle and we know a lot more about America's newest sweetheart. She was, in fact, born in Lebanon and immigrated as a child. The charming Rima is a graduate of the University of Michigan-Dearborn and is hoping to attend law school when her reign is over. Perhaps a career as an immigration lawyer?

I will start working Jan/2007 as OPT. The company will apply H-1b for me after April.1st. At the same time, I also apply for phd program and I am not sure if I can get school offer. I believe I will know the result of phd application before the H-1b gets approved.
My question is:
If I get school offer, I know it is easy to cancel H-1b but how to cancel change of status? what is my status after I leave the company and before I go to school? what do I need to do to keep OPT until enrollment?

I don't meant to scare you but this shit usually happens when they are reconsidering the decision when the sponsoring employer withdraws your H-1B. Check with your company's/lawyer if they accidentally submitted withdrawal of your H-1B petition.

I am waiting for the approval of my I-131. Can I fax a request to approve/speedup the process? If I can send the fax, can someone pass the fax number?
Background:
I applied for I-131 online in May, 2008 at TEXAS Service center. I applied before 120 days of the expiration. In December 2008 I got an RFE asking for the reasons why I applied before 120 days of expiration of AP authorization. I sent the response on Dec 11th.

I have a ticket to go to India. I am traveling through the following route
Boston- London- Bahrain - Bombay.
I heard that I need to have transit visa for UK as my connection is in UK (2 Hrs).
I don't have the UK visa and I will not have the US visa at the time of entry in UK.
I have very sort time now in my hand.
1. I really need to have the UK transit visa?
2. Yes then how to get this?

My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

HOW CAN ONE CHECK THE STATUS OF THE PENDING NAME CHECK OR SECURITY CLEARANCE BY THE DHS AND/OR FBI WHICH IS CAUSING A DELAY IN THE APPROVAL OF I-485s?

If I file my I-485 through my lawyer, will I have to be with him for all subsequent EAD/AP renewals as well or can I renew them on my own?
