You didn't indicate the reason why your friend's H1B got rejected. If the H1 got rejected due to the problems with the company sponsored the H1, then it's highly likely the new H1 will get approved.

I got an H1 from an employer with changes of status from L1 effective 31- jan but I will be joining this company only on 4-april-2011. I continued to work for L1 employer till
20-Feb after which i returned to India.
Now i have my visa interview - will i face issues because of the 25 days i spend with L1 employer and that I dont have H1 employer pay stubs?

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

I'm surprised no organization is following up with USCIS about the prompt monthly updates on pending Volumes. So much for the push for openess during the 90 day initiative by the President !

I have heard in the past from core team and other senior members that
we have to bank on CIR for now, and if it is dead SKIL etc become an option.
The one problem with this might be "how and when would we know CIR is dead, and would it be too late to push for SKIL at that point?".
I understand this is a highly speculative question, but am hoping someone from core can articulate what our game plan regarding contingencies are.
(If this is something you can't answer on the webpage, I can understand the reasons for keeping the gameplan under wraps from our adversaries).

WASHINGTON - California voters continue to disapprove of Congress even more than they do of President Bush, and for the first time Speaker Nancy Pelosi's ratings are more negative than positive, according to a Field Poll released today.
The poll found that 22 percent of state voters approve of Congress' job performance, with 64 percent disapproving. The discontent was bipartisan, with 70 percent of Republicans, 63 percent of independents and 58 percent of Democrats giving Congress negative marks.
Those findings, taken in a survey of 1,201 voters from Oct. 11 through Oct. 21, track national surveys. A Los Angeles Times/Bloomberg poll during the same period also found a 22 percent approval rating for Congress. A CBS Poll registered a 27 percent approval rating.
Bush earned a 27 percent approval rating from voters in the same Field Poll.
Political analysts give several reasons for the low marks: Democratic voters' dissatisfaction over the inability to change Iraq war policy, Republicans' opposition to Pelosi and other Democratic leaders, and a sense by many voters that Congress can't come to grips with tough issues such as immigration.
"Republican reaction has remained about the same this year, but the real trend is that rank-and-file Democrats and non-partisans are displeased because they expected more from the Democratic Congress," said Mark DiCamillo, director of the Field Poll.
Pelosi, a San Francisco Democrat, earned a 48 percent approval rating in March, two months after Democrats took over Congress. That dropped to 39 percent in August and 35 percent in October, with 40 percent disapproving and 25 percent registering no opinion.
"Iraq is the anchor weighing down Bush," DiCamillo said, "and now it's an anchor on Pelosi because of the complete inability of Congress to change course on the war."
Pelosi and other Democratic leaders held meetings in the last week to find ways to improve their "message" about what they call the New Direction Congress, highlighting such legislation as the minimum wage increase and ethics reform.
Despite the low marks for Congress, Republicans had little to cheer about in the new Field Poll. Voters gave an approval rating of 34 percent to Democrats in Congress, and 20 percent to Republicans.
Only 29 percent of Republican voters in California approved of the GOP performance in Congress, with 53 percent registering disapproval.
"That 2-to-1 disapproval by their own party really jumps out," DiCamillo said. "Republicans in Congress are now playing 'prevent defense' for Bush on the war and on domestic issues, and Republicans in this state do not approve of that."
The state's two senators, Democrats Dianne Feinstein and Barbara Boxer, earned higher marks than Pelosi and Congress overall, but the approval ratings for each senator dropped 10 percentage points since March.
The survey showed that 51 percent of all voters approved of Feinstein's job, with 31 percent disapproving. Boxer's approval rating was 44 percent positive and 35 percent negative.

I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?

I am planning to invoke AC21 thru H1 Transfer and then notify upon H1approval.
Do we need to make sure while filing H1 transfer, job duties on H1/LC should exactly match Labour Cert job duties?
I know while notifying it has to match.
Appreciate your help.

I know a friend who has done Bachelors in Computer Application in india. She is now in US and wanted to know the options for working or studying in US.
Is she eligible to take up MS degree..???

Hello,
I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?

As the article stated there are 47 million latinos and majority of them are citizens.....we don't have that kind of numbers to make an impact on either party.
