In Mid 2007, 7th year of H-1B tansfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...

Please help me, married a us citizen right after 3 months I have my green card in 08 we got into a fight and she divorced me 2 months later and finally decreee june 2008. we are back together and live in the same house hold and in feb 2010 when my green card expire and I need to file to remove the condition, I dont know what I or we need to do?? is this the better way is for us go down to court house and get married again? we still have banking account together and bill together>
Please let me know what is the best for my situation.

USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."
Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. I had visited US for 6months in 2005 on H1B visa and currently my H1B is expired( Expired in Jun 2007). Now, I am in US on H4 visa. Can anyone please let me know is it possible to renew expired H1B now? If so, what is the procedure for the same?

1. Create a page in Immigration voice that indicates clearly �retrogression issues�
2. Then we �users� can try to sort of �market� it so that this page becomes most hit page, and becomes first few pages that shows up on top in Google search.
I hope I am able to express myself. Comments please.

I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .
Will I qualify for 3 year H1 extension based on my approved I-140 .?

Consider a consultant-only company where all employee work on client projects and all got EAD and can change employer anytime they want. What happens if everyone leave the company after 180 days and you (and few other) still continue. As this will have great impact on company balance sheet how this may effect final GC approval of those still continue? Most of us will have to wait 3-4 years before we get GC approved. Can it cause any problem or RFE? Or I-140 approval must be enough to show that employer is able to support the employee after GC approval. Just a thought.
