In my case, i do not have a valid H-1B visa stamp. I recently visited India and used Advance Parole. Questions related to this
1) do i need to surrender my PAROLE I-94 before departing USA?
2) does canada immigration officer ask me why i have applied for canada gc while my USA gc is in process?:confused:

If you wanna return to the US from Canada, you either need to have H1B visa or AP.
Your Canada Immigration Officer may ask why you want to settle in Canada and you should have a convincing explanation.

I filed I-485, I-131, I-765 for myself, my spouse and my 10 year old daughter. The papers were received at NSC on 30th July, 07. Three days back we received all the receipt notices with receipt date shown as Aug 1 and notice date shown as sept. 10. All fine so far.
I then went to USCIS site to check on-line status, but here was the surprise. It gave the correct status of all the receipt notices, except that of I-485 and I-131 for my daughter. When I key in her receipt nos., I get the message that these nos. don't exist and I should enter the correct no.
Now what is that? How come my and my spouse's record is entered but not of our daughter's inspite of the fact that we have her receipt notices with a proper receipt no.
Can someone suggest what could be the reason and what course of action I need to take so that the situation is corrected. Help please

Hi Guys,
I came to know that if there is a significant increase in the new salary compared to old labor salary, the chances of getting a query is more.
Let us assume that if you old labor salary is X and if you want to take up a new job with X + 30% or more the chances for USCIS query is more.
If the salary increases between the jobs is 10% there should not be any issue.
Of course, these words are not from an attorney, i talked to a senior guy who is in this profession.
Before you are planning to use AC 21, please consult with attroney first and they only accept the new job.

Atlast all my checks are cashed today. I am able to get my case number from the checks. Even though INS received my application on June 6th, in my 485 it says that they have received my application only on June 11th. Wonder why?

I know quite a few people who have gone back in the last year ;), and contrary to perception are quite happy with the choice they made.

CPO today. Case at local office. Had 1 interview where all documents for status and taxes were checked for the past 12 years. Never had a problem or gap in status and IO was surprised why the case came to local office. I was atleast happy that the interview is the worst thing that can happen and I am done through that.
After 3 infopass appts, 2 SRs in all have the CPO in hand.

1) If the dates have retrogessed to 01/2000, that means that there are atleast some cases of 2000 that have now been cleared for processing and will be dealt with first before the rest.
2) It also means that there are sufficient numbers of these to have caused this problem. The numbers might be sufficient to use up all of this years allocation?
3) once these severely backlogged cases are cleared may be we can see some forward movment?
Either way this certainly adds a couple of years to the already 4+ years of average wait. Without much exact information from the USCIS we can do nothing other than start the next prediction:D
For sure legal alternatives wont help. the country cap is to ensure equal opportunity for smaller countries which dont have enough infrastructure as large countries such as India/china. We cannot expect the country cap to be removed.

My Apologies if this seems a bit rude to you...
IV is specific for people those who are awaiting permanent residence...but looking at the recent set of events for those who are not in queue and are new here with just 2-3 years of stay in State....on H1B...
Following is happening and it has a reason...I know many of my friends who have been denied H1B, L1 extensions ..these are those people who have just started PERM...
EB2 dates moving to Jan 00 and other not under U, has a specific reason as well; quota is one reason but it is not the only reason in the current state...these is another means to make sure that those who are trying to get GC and other who are trying to stay for 6 years under H1B should be putup into a spot that the thought of leaving this place and ending up back home becomes a reality..
I am sure out of total 500K awaiting the GC process, will have now atleast a second thought of going back home...H1B and L1 under 6 years are now also being forced to return back....
