    I just called and spoke to a staff member at Lamar Smith's office. Apparently a lot of calls are being made :D. She knew why I was calling before I could tell her. I was told that the Rep. has not made a public stand on these bills yet. I told her that I would like the Representative to support these bills if and when they come to the floor.

    This is very interesting. Please keep us posted on future developments like when you get your card. Lot of us have been debating about RD and ND. The fact that you have got an RFE on your 485 application is also interesting. It could really be your GC.
    Have you recently applied for you EAD? They might have approved your EAD and updated your status for the 485 app by mistake. Just trying to over analyze the situation :). Anyway keep your fingers crossed till you get your physical cards.

    Earlier today I got an email from USCIS that said
    "Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Card production ordered.

    On June 29, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

    Then by the evening my I-485 said
    "Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Notice mailed welcoming the new permanent resident.

    On June 30, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

    The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

    Thanks for your feedback. But processing a '05 labor cert before a '03 labor cert is injustice at the most ugliest form. No where, I mean no where in the world are people going to accept someone who came later in the queue to be allowed to have service before people who have been waiting for years together in the queue. Why would anyone do that and how is that justified? It is a mental worry and stress for the affected folks right now because we are still waiting with uncertainty. Why should we? Why????

    So whatever happens in the future isn't the concern. There are no guarantees offered as you know with these processes. If it happens it happens and we will take it at that time.

    The point is to bring to the attention of the proper authorities this injustice in the system and to make sure that we are guaranteed some form of relief/concessions. As you know the filing fees are going to increase and again there are no other guarantees.

    As I said your claim is a valid one. Having said that filing a lawsuit against the agency and getting a suitable verdict is very difficult.

    Its seems you are new to this area (lawsuits) and I would recommend you to do some research on how many immigration complaints that were filed during the past 10yrs ended with the plaintiff winning.

    Lawsuits in the US is all about money. Its not like getting an attorney and filing a complaint and then hope to win. This is why people always like to go for settlements since lawsuits can be thrown away even before a trial during summary judgement. Do you know what is the average fees for an attorney ?
    And do you know how many attorneys you might need to make a strong case ? Do you have any idea of what kind of Judge might preside over your complaint ? Do you know what is discovery ? Do you know the onus is on you to show that USCIS has broken the law ? Its not enough to tell the court the USCIS has made a serious mistake. The court will not listen to that argument. You will have to proove to the court what is the law that the USCIS broke.

    I am only telling this from experience as I know this game inside out.

    You can sign on on behalf of your son and you can place (father/mother) next to it.. This won't need a G28 form.

    I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?

    G-28 form says it needs to be filled in case if you use Attorney or Representative. Just wondering whether I need to fill a G-28 form for the above AP renewal application for my son since I am filling Part 9 in his application.

    Can somebody clarify? Thanks for your help.

    Something seems amiss here ...the Wednesday & Thursday before the original CIR was stalled - Friday June 8th - there was a lot of tech industry lobbying with Senators including drafters of the bill - both ITIC & CompeteAmerica have releases on their website dated 06/08 - the day the bill was stalled- urging the Senate to take up CIR again - the following week there were press reports indicating some industry backed provisions would be included in the bill if & when it comes back or at least they would be bought up to vote. It is hard too believe that the list of amendments to be offered now do not contain even one single such provision. There is definitely something more than meets the eye here. It is difficult to fathom industry just watching from the sidelines & allowing 2 Sanders amendments to be passed

    Please and i'm begging you that please read the entire post and think for a moment before replying. I'm not in BEC, already filed my 485. I'm aware of the IV efforts towards getting relief for BEC people, I never disputed that. My point has been that the system and July bulletin is unfair (at least from one angle) and that calling it unfair/unjust should not upset others. I don't know what words were used by Bigtime and banning him was fair or unfair.

    You want everyone else to suffer just because you suffered? or because older pd's suffered? life is not fair so get over with it... the sheer fact that you are in this country is a god's gift to you! So dont be judgmental about things...

    btw my pd is feb 2003 and i'm very happy for everyone who will get the opportunity to get in the door!

    07/21/2007: RFE/NOID Flexible Time Frame Rule and Need for USCIS Discretion for Pe-July 17, 2007 EB-485 Filers

    July VB Fiasco was a tragic event in the American immigration history and we are grateful that the USCIS rectified the problem on July 17, 2007 by reversing its decision to deny July 2007 EB-485 applications. We do not have specific statisics on EB-485 filers from July 2, 2007 until July 17, 2007. However, for the two reasons, among others, a large number of applicants sent in EB-485 applications during the period. Firstly, they more or less anticipated that either DOS or USCIS would rectify the problems because of the potential serious flaws in their decisions. Secondly, AILF was preparing class action lawsuits and they wanted to make it sure that they took advantage of being a member of the class without actually being named as plaintiffs. One time, people thought it was a smart move and right thing to do it, even though this reporter suggested to the people to wait until August VB was released.
    Currently, these early filers are literally going through nightmares, hardships, and sleepless nights because of the two reasons. The first reason is that their cases have been on hold and no Receipt Notices have been issued. The second reason is that recently the USCIS revised its rule (1) allowing the adjudicating officers to exercise a discretion and issue a RFE with the response time of less than 12 weeks and (2) to exercise a discretion to either reject or deny a petition or an application without issuing RFE when the "initial evidence" is missing in the filing. Combination of these facts is currently creating a turmoil to these filers for the two reasons. There are some filers who submitted I-140/I-485 application without a sufficient documentation in haste, for instance, medical report, or other flaws in the submitted evidence. These people are restless not knowing whether their application could be rejected or denied, indeed a truly deadly consequences. The circumstances force them to wonder whether they should refile the petition/application before August 17, 2007 not to take any chances. There are, however, two hurdles to such decision. One is the recent denial of I-140 petitions by the adjudicators if the petition was not accompanied by the "original" labor certification. The another reason is no fixed rule or policy on the filing of multiple I-485 applications. This creates a fear that their second filing may also be rejected or denied. They are thus trapped! The second victims are international travelers. If the application is either rejected or denied and they are present in the U.S., they will be able to refile it after correcting the flaws in their initial evidence before August 17, 2007. However, when they are not present in the U.S., they will be deprived of such opportunities, which may be considered "deadly." Some people are still present in the U.S. at this time, but because of business or personal emergency, they will have to travel outside of the country using their H-1B/H-4 or L-1/L-2 visa. If their cases are rejcted or denied during their absence, they will not be able to refile it timely before August 17, 2007. They are trapped again! Their act which was considered a right thing to do to one time turns out to be a nightmare. Who would have anticipated the nightmare?
    We urge the USCIS to consider the following actions to relieve these applicants from the unnecesary hardship:
    Under he RFE/NOID Flexible Timeframe rule, a decision to reject or deny without a RFE remains a "discretion" of the individual adjudicator in each case. This reporter proposes that considering the unusual circumstances involving the July VB fiasco and the USCIS unusual remedial action at the last minute, the USCIS exempts these filers from the rule and make it mandatory to issue RFE before rejection or denial unless the following flaws are found in the filing:
    No filing fee checks or flaws in the filing fee checks
    Missing signatures in the forms
    Missing forms
    Missing underlying certified labor certification application for I-140 petitions (either original or copy).
    Should the filers decide to refile it before August 17, 2007, the USCIS should accept a copy of the certified labor certification application rather than rejection or denial of the refiled I-140 petition. In fact, it has been the INS/USCIS tradition to accept I-140 petition with a copy of the certified labor certification application inasmuch as the original was on file with the agency, albeit in other file of the same applicant or other applicants. Accordingly, it should be a matter of adhering to the tradition and to instruct the adjudicators not to reject such refiling on the issue of a copy of the certified labor certification application. Additionally, inasmuch as there is an evidence that the labor certification has been certified by the DOL but the applicant was unable to submit the original or copy because the application was lost or yet to be delivered to the applicant, such I-140 which was filed during the period should not be rejected or denied. Again, it has been a tradition of the agency to request a duplicate certified labor certification from the DOL by the agency itself when there was a proof of certification. We urge the USCIS to exercise the discretion and instruct the adjudicators not to reject or deny I-140 filed during the problem period for the reasons of missing "original."
    Foregoing actions will relieve these filers from most of the nightmares or status of being trapped. It is thus strongly urged that the leaders of the USCIS extend a compassion on a human level and exercise a discretion immediately to take the foregoing actions. This reporter has been receiving hundres of emails from these filers and had to share the pains and emotional despair since there was no answer to the foregoing issues under the curcumstances. Since the deadline of filing is August 17, 2007, the USCIS should swiftly release an announcement to relieve these people from the problem "effectively." On behalf of all these trapped, this reporter personally pleas the leaders of the USCIS to act quickly.

    No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.

    India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

    I have much better lifestyle and opportunities than Canada or even western europe! Period.

    Going back to India is not a bad option at all, but it is really subjective to each individuals about what gain we are going to get out of gaining GC or citizenship from US or Canada like settling down in these countries for good or moving back to country of origin later. In my opinion gaining citizenship from US or Canada before going back to India will be always advantageous, one future perspective these countries have bilateral agreements with other developed nations where you can travel without visa for business trip or for even jobs where you're treated differently as against India citizens(Asian origins doctors who work in UK know this difference). Its a known fact that the pay structure in Gulf countries are different based on the citizenship.

    They are worse.. they do not respond quickly, never let you talk to attorneys directly.. have to go through the secretaries and to top all this they mess up the applications.. in short they suck!

    I think, many of us go to Murthy.com for the news and latest updates at no cost. This is the best service this firm is providing to the community. I believe, it is most reliable and up-to-date info center (I have my attorney in CA but during last 4 weeks I got answers to my questions from Murthy.com only!).

    Whether it is Sheela Murthy or para-legal assistance, it should not matter as long as a right response to a question is given unless someone is looking for a doctor not an attorney in Murthy.com firm.

    Let us hear what other thinks.

    PS: My lawyer did not do anything after 02Jul07 - no communication at all - just one song " I-485 date is not current anymore; wait until October VB".
