I am in a similar boat I got by second 140(EB2) approved this week. How do I know if my date is ported? Acutually I dont care about porting date I just want to find out if my new approved 140 is now referrencing my 485(filed under EB3) filed in July 2007.

Did you check the New I140 approval notice? The priority date on the latest I140 will have your Old PD. I believe its also advised you file an interfiling request.

i think AC21 is a law passed by congress. So no matter how it is but it has to be followed by USCIS.
Now a days USCIS staff doen't have correct knowledge about AC21 so with out understanding they are rejecting.
Initially I got my H1 extension only for 1 year even though my 140 is approved and 485 filed. Then i fought to USCIS and showed the pdf doc from AC21 which states that they have to issues 3yrs extension.
Then they issued for 3yrs.
It is all lack of knowledge abt AC21.

Just got my 140 approved...no confirmation from the employer yet but received email from CRIS saying they mailed the approval on April 15. Looks like the published processing times are being adhered to.

i just returned from an infopass meeting... the guy i talked to said that they recently have a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff and hence they are planning to adjudicate a record number of EB apps in the next quarter or two... does anyone else concur? is this true or were my ears just ringing in that meeting?

When you have these news articles ready...one of the easiest way to circulate them is using a news wire agency.
I have used http://www.prweb.com/ before for my company news releases. It is free and if you want a broader reach pay $80. It is very effective.
It is a good idea to release it when something related to immigration is going on in senate or house. During this time, all major news network pickup articles from these wires based on keywords like "immigration, border issue etc"
So make sure you add appropriate keywords when you do the release.

It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.
It's confusing indeed.
One of IV members 'lazycis' (he is a knowledgable & senior member) also mentioned this, which exactly matches with what RG said:

Not sure if something is cooking at USCIS, last week an USCIS office called my attroney to get clarification on why we (my wife and I) are residing at separate addresses. We are in the process of relocation (company moved), my wife chose to continue her employment while she's searching for opportunities in the new location. The officer stated that they are trying to adjudicate the cases ASAP, hence he's inquiring to ensure there isnt any marriage fraud. My attorney responsed back will all the possible evidence to proved we are together.
Has anyone had a similar experience.

It is not pre adjudication process. It is aggressive denials.

I have applied for labor certification in Dec 2006. In may 2007 I got a denail stating that the company is not "bonafide". It is a new company and I am the 1st applicant for labor. We sent all the supporting documents and requested for review/appleal in May 2007. Since then we did not get any status from them. My attorney called them last week and made an inquiry. DOL Atlanta said that they need to do the "central check" of teh company. They do this for every new company. Does anybody aware of this "central check". How long it will take?

How insane am I? How insane are u? If it was not the USCIS, u wudn't have put ur foot into this country using ur H1B visa. U r in a foreign land and u want things happen like at the snap of ur finger? U think immigration is the only issue US has. U donno nothing about other issues the Govt is facing. If u dont like the administration...just get out. How in the world can a foreigner think about changing USCIS management process? What rights do u have? U cant even vote and u want to change the management process of a Govt body. U think u r a citizen and have all the rights. Kudos to the US Govt for making us feel at home and letting us talk like this. IV can fight upto some extent by the kind of campaigns they are hosting. But its USCIS' prerogative what they want to do. In the first place IV is fighting for Employment Based GCs. The fight which should actually be fought by Employers and above all ppl like u have the audacity to talk about the irregular management in USCIS and even going to the extent of changing it. And they took the shortest and safest way out? U think they wudn't have gotten away by NOT letting u have ur EAD now? U must be from India where there is lot of corruption. How wud u feel if US citizens came to India and propose a change in the Government. US citizens who are immigrants in India - Did u even think about it? U dont even know how to think properly.
