If approached in the right way there is a chance that big law firms will be helpful to us. The way to do this is politely, not raising a stink, with a credible number of their clients supporting us. The big law firms could act as a "force multiplier" to use a military term, only a small fraction of the community currently know about us, the big law firms and USCIS are the common connection for EB GC process, and USCIS is not about to email all their customers about us. With the right encouragement law firms might just help.

I do understand the need to vent and rant sometimes. My personal guide is not to post anything that I do not want to be publicly (or legally) held to. Also a balanced constructive post is useful for all. So I place my full name in my signature.

Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

I have six other guys who are in US for over 7 years who are also intrested in this admin(hopefully) fix . Please let us know what we can do? They just signed up@ immigrationvoice.org.
I am very interested as well. I find this highly ridiculous that people have to wait 6-7 years to get residency status in any country. It is high time that the laws of the land change.

please to make thingis clear i no undersstand. i think i telling my friend noone is explainning thios clear. he tells me he get ead/gc from help with iv. i thinking i too want to see how help iv me. i eb3 with lawyer apply in this year janrurary. lawyer tell me wiat gc 15 year. i says to him ok but i think he lie. mi h1b for 3 year and then i appplyl again h1b extension. i test analayst qa. so i make cleaar now some one some body help usnerstnd what happening

My PD is April 07.
I got two LUDs on June 26th and June 30th out of the blue for my 485....
Not sure why...
I applied for EAD renewal on June 24th though.... but I got LUDs saperately for these two too but on idfferent days

Just to add.... porting process is legit for EB-2 as well. EB-1 is current now. :p

Porting process is a legit process and for well qualified EB-3 india folks thats the only ray of Hope.
You can rant about it but noone going to stop the porting process becaue the folks who initially filed under EB-3 are now eligible to get Job promotions , new roles and responsibilities in their Career and in some cases new Sr. Job positions which are qualified EB-2. By the way they do file new PERM labor and new I-140, it is not a automatic qualification just based on number of years waiting in the endless EB-3 india queue.
Under the current circumstances where EB-3 india doesnt get any spillover numbers or any such relief like VISA recapture bill, do you expect them to go behind the lines with new EB-2 PD? What about the wait period in the backlog centres, in the PERM process and for few I140 stage waiting period? Its the law and people are following it. You can try porting to EB1 if you are qualified enough and port your EB-2 PD to EB-1.
Just because you are qualified initially for EB-2 doesnt mean others are inferior and they are not eligible to port to EB-2.

I called the USCIS just now, and they told me that they can tell the receipt number to ONLY my attorney or my employer, provided its already in the system. I filed on July 5 ( NSC), and hasn't got the receipt number yet. There is only one person in my company to handle hundreds of GCs, and the person is very busy processing all these I-485s, and will not pick the phone for any enquiries, no reply for emails etc. so i am stuck! so i dont know whether they encashed the check or not!
if u say u r the employer, then wat questions do they ask to verify that u r employer. i think they ll ask the questions from i-140 form only.

Folks,
Please Ignore people who are obviously here to create confusion and to discourage and bring down the general morale. It causes a drain on the energy of the *Volunteer* Core Members. We should never lose sight of the fact that this is the one and only Forum that has our goals as the Priority and it is the *Volunteer* Core Members who have taken the initiative to try to get something done. The very fact that we have this Forum and that we have a coordinated effort to try to get some thing done to address our issue is worth the money that I have contributed and will continue to contribute.
What will I do with a few extra 100's when I have no security?
Folks please understand and support the effort. Be Positive and keep the energy effort and drive UP.

If you want to file law suite, you should have done that long back.
You should have done it when PERM was brought into process. Also, there is nothing said in PERM process that people should not re-file.
But blaming the process just because every one is made current is wrong. If some one knew the know-how, and was in hands of a good employer, even people who came in 2007 are ready for 485.
The whole immigration system is messed up. It is sad to see people stuck in BEC suffer, but you all had every chance to re-apply and you have every right to be in front of perm people, so is it goes when USCIS is assigning numbers.
Also as posted by members, if all cases would be cleared by 2007 Sep, than you all have high possibility to be in the next VB, which could only be few months away. Also they might bring speed 140 back.

Y have contry quotas, let it be all merit based.
You want me to believe that there is no discrimination, I laugh at that thought, u r just fooling urself, it's part of this country, it's part of their culture, not that India is any better, but u can't ignore the fact that there is very active discrimination in this country.

Thats a good point Harsh. If they are reluctant to increase the H1 cap they can simply look for the talent in their own house (USA). After all we all are paying taxes and can contribute to the economy. and also we should seriously think about lobbying for issuance of EAD to H-4's once I-140 is approved.

I had something similar happen to me once. You should definitely file a complaint, and you might be surprised with the results. Hi,
I had invoked AC21 and informed usc thru my old attorney.
Now Frago...is filing my EAD,AP extensions and asking me to file G28 for AP and EAD only.
They agreed to keep 485 G28 as is so that old attorney will take care of it.
Do you see any issues here?
