Hi All,

My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??

Hi All,

How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.

1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?

Please suggest if there are better ways to handle the situation.

-- How long does it take to get H1-B visa under premium processing, if applied in 65000 pool?

I'm surprised no organization is following up with USCIS about the prompt monthly updates on pending Volumes. So much for the push for openess during the 90 day initiative by the President !

Going by the charts and Dashboard one would come to think the September volumes has whittled down to Zero !! Hmmm..

Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

Hi all,

Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....

I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...

So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.

Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!

If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:

1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.

Q & A:

1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.
