    Has Any Senetor Brought An Amendment To Reinstate Ac21 Provison To Eliminate Country Quota(10%), If Demand Of Visas Is Less Than Supply? The Orignial Spector Markup Deleted This Provision From The Ina. This Is A Big Blow To Oversbuscribing Countries, Unless The Current Markup Is Modified Thro An Amendment.

    Is There Any Update From Iv Core Members On This Issue?

    Send your recommendations to USCIS/DOL and your certification about bsc and bcom. Also enlighten us with your larger perspective of how this multinational executive making 32K per annum adding more jobs/potential to the economy.

    I have nothing to recommend to them as things are fine as they are. And there will be no recommendation coming from me to close any door at all, whether it be for EB2 or anyone else.
    You can go ahead and recommend against EB3 BSc BCom losers, as it is your business

    To shut down a program because of a few mis-users : I am sure you WONT agree to extend this logic to your precious EB2 application when someone points out how someone else misused it

    I don't know if anybody has noticed it but the dates for EB-2 for VB October 2007 was April 1, 2004 and for VB October 2008 is April 1, 2003. That is a retrogression of 1 year - not good. :mad:

    And then you must have also noticed that in Dec 07, it moved to Jan 1, 02.
    Jan 00 in Jan 08, U in Feb-March and then April 03 in April 07.
    With due respect, I don't think what you have observed really points to anything, either way.

    Eventually, EB2-I will move forward, probably next April or so. And yes, this is all good old speculation, it doesn't mean anything really.

    Alright Guys, Let's ignore this Dard-e-disco guy he doesn't deserve a second of our time. To answer your question, one thing atleast USCIS can give us is, Release data like How many applications they have already received from Major Green Card Seeking countries and in which EB categories. All this data they would have entered in their computers, They can easily run these kind of reports, I'm sure they'll be having some Data Warehousing softwares. So atleast everybody of know where we stand today and stop predicting cut-off dates etc. etc.
    They can also make sure they send our APs and EADs in less than 90 days....

    Why ignore him? He's got a very valid point. You can't just abuse USCIS everytime your GC is delayed. Our GCs are delayed too.

    IV is trying its best to help resolve this issue but that's all we can really do. We are aliens on a foreign land. If we don't like the way things are going here, we can always go back to our country. We are free to go.

    Blaming USCIS will not help. Dura Lex Sed Lex (The law is hard, but it's the law).

    Man, in frustration people do not even know what to say and what not! Be very careful of what you spin and what you say. From the looks of it, this stuff has every chance of spinning out of control and it may have already started the ball rolling.Think about it for a second!. Once it goes that way, trust me, we will all live to regret that.
    Yes, DHS approved upwards of 25000 GCs over the weekend, leading up to July 2nd. And some people are pissed off at that, err..why?
    Remember, those 25000 are one of us. Once,they too were in line for Labor certifications, I-140s, medical exams and all that crap. And some of them were in the so called "FBI Name check" black-hole for an extended period of time. We should be rejoicing in the fact that most of those backlogs got cleaned up. Instead we have people questioning the validity of those newly approved GCs.My dear friends, god willing, we will all have GCs one day and tell me, how would you feel if someone else comes screaming at you just because he did not get one too.
    Putting a "security lapse" spin on this could be very dangerous and should be avoided at any cost. I hope one of those anti-immigrant lobbies do not pick it up and start running with that. I prey that they do not revoke those already approved GCs, because if they do, then those poor 25000 souls will go through much more agony than what we are going through now.

    It's very tough to get the genie back in the bottle once it is out, so think before you start popping that cork.

    you are right.
    therefore iv's stand on this has been very careful.
    we are happy that uscis is showing great efficiency. the fact they screwed up with the original visa bulletin is a whole separate issue, the question is- why are we suffering for their mistake?
    all iv memmbers are encouraged not to harp the security issue, it's not in our interest.

    I guess that's us, got that from Thomas Library. The bill is being considered in the Senate.

    Durbin also got one "favorable" amm. for us - another $1500 for each recaptured visa number. I believe after all expenses, and all time spended on the immigration and exams, majority of us could deal with that extra cost, or "bonus" if you like::))) So I hope that Durbin's amm. will calm down anti-immigrant forses and Cornin'n one will pass!

    I got the same message on 4th jan and received the AP documents from my employer today..probably it may take 10 days to receive from USCIS through Attorney/Employer..don't worry..you will receive on time...

    Looking at the recent approvals looks like USCIS does the following:

    1. Pick up x number of files using a random algorithm.
    2. Arrange these files in a random order using the same random algorithm
    followed in step 1.
    3. Randomly pick any file arranged in step 2.
    4. Toss a coin.
    5. On odd dates if it is heads,approve the file. On even dates if it is tails
    approve it.
    6. If file is not approved in step 5 put it on the shelf to be picked up
    in step 1 in next cycle.

    True , hope it will relieve as house sees through it and will make life of all easier by making it amendments or even drop the whole law , We dont want it.

    But also can some one point to me to place where it says H1B is not dual intent , i could only find DUAL iNTENT for some students.

    It was in shutterman's website that was quoted in this forum somewhere reg dual intent provision.

    Did any of you get the same letter with the same content below .........what baffles me is the last sentence that says "The application will be reopened and the processing continued. Once the processing is completed, you will receive a notice under separate cover."

    Your help is really appreciated in this.........Sorry I am little bit pessimistic here......

    You should find ways to participate if you click on the orange Action Alerts link.

    Also, click on "Advocacy" and "Volunteer" in the blue menu bar at the top of every page. You will find TONS of things to do on an ongoing basis.


    Did you:
    Join your state chapter?
    Send letters for FOIA campaign?
    Send letters on the spate of I-485 denials?
    Send letters to Senators regarding Housing Crisis?
    Participate in Team IV?

    All links are available under action alerts and first post of each of those threads has all the relevant information. I am not sure what other information you are seeking.

    Hi! I have some questions:

    1. Do you have a lawyer when you filed the first MTR or did you do it by yourself?

    2. Did you submit a copy of the I-140 approval and the AC21 memo during MTR?

    1. Yes, I have been having an attorney all the way thru the two MTRs

    2. Yes, I-140 approval copy was present in my first MTR. My first MTR did not have AC 21 memo. AC21 memo (2003 Yates Memo) was present in my second MTR when we filed it. Of course, I-140 approval copy was there in the second MTR.

    Even if many people write a few times to the same reporter it is ok. Make sure it is not a spam. This means,send a personalized letter and try to use different templates for cover letters.

    After the july fiasco, USCIS need not have to worry about recieving huge applications if they move the dates forward. Since almost all the folks (except for folks stuck at BEC) would have turned in the applications uscis should be able to move the dates forward for FY08 to a big extent , so that visa numbers are not wasted.

    but again it all depends on how they view this.These are cry from our end..

    Yup, because of July '07 there will be no wasted visas for several years...

    I am wondering whether USCIS made that mistake on purpose, after the immigration reform thing failed in congress?

    Is it legal to pass the fee hike to the employee? or is it like the Fraud Prevention fee which is illegal to be passed on to the employee..?
    this will change the equation until companies assimilate this in and find the work around! well, it definitely eats into their 'profit' i guess!
