Senior members & Experts , please clarify on this issue
1. I'm AOS aplicant currently working with company X in US and planning to go to abroad and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and continue with GC processing?
If above can't be done
2. Assuming I withdraw my 485,so i will on H1B status. If H1B applicant currently working with company X in US and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and later continue with GC processing? - or H1B status abandon as soon as i change employment in Abroad
Please provide your suggestions

Mine and my wife's 485 must have been "touched" today ... not sure why though. The status still says "Case received and pending..."
Any ideas fellow members? Could it be good sign or just standard update...?

Hi
I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.
Please someone respond.

i have changed my status from F_2to F-1,
yeah you can go to canada, or mexico. even india, i went to india.
All they look for is funding, if your wife has funding from the university in which she got admission that is enough.

Hi All,
My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.
What are the best and low risk options to convert to H4 status. Please advice

She most likely is out-of-status for a long time (more than 6 months). Also she started/would start accruing illegal/unlawful presence from the day her I-94 expired/expires. Talk to a lawyer before doing anything.

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!

They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o
So can't say how that would be advantageous but nevertheless the economy is boomin and there are lots of jobz.:)

My H1B was approved for location A (MICHIGAN),ONE MONTH AGO.Now my employer wants me to work in location B(PA).My question-
Do I have to wait until labor is approved for location B or can I start working from monday and labor(for location B) can come in 10-15 days thereafter.I am a PT.

I have a problem. My Employer want to know how long it`s take to become the EB3 Visa, I meen after PERM, I-140. I`m from Germany. I have read that it`s take 4 years till a visa will be available. It`s really so?

I have received an email from USCIS that
Current Status: Approval notice sent
"On XXXXXX, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service."
This is the case regarding the application for my brother\sister. However, it's more than 10 days and I have not received the letter yet.
Called customer service and they said to wait 30 days.
Also, the processing time showing is March, 1999. I am bit confused what shall I do now. any suggestion or help would be appreciated.

There is a job opening at client place and job opening title is "JAVA DEVELOPER/SR JAVA ENGINEER" and the responsibilities includes coding Java. I do not have approved Labor certification with me but my Labor application (Signed copy by me) say Job Title as "Programmer/Analyst" and responsibilities includes
"Analyze, design and develop applications using C++, Java, J2EE and Oracle."
Could you please let me know if I can work on EAD for the above job position at the
client place using AC21? I prefer not to talk with client if the labor and client job
requirements does not match.

My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.
I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.
Please I need help is anyone can advice me in this. I really need it.

In case I lose job with the current employer, and the employer withdraws H1-B and I140, what are the options I have?
Can I transfer H1 or apply for H1-B with another employer? How much grace period I have to leave the country?
Appreciate any help from you guys.

It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future
