The U.S. Immigration and Customs Enforcement (ICE) announced today that it served Notices of Inspection upon 652 businesses around the country. Compare this with the 508 businesses which received Notices of Inspection in fiscal year 2008. An ICE spokesman told the press: "Part of the strategy is to show businesses that we mean business." Hi,
I know your time is very precious and not to waste.
My issue is - I came to US as a programmar/analyst in Aug' 2005 with my B.Commerce (3years) and Master of Computer Applications (completed my 3years masters by 2003) in India. My H1 company in March'2008 applied for PERM/I 140 through EB3 (as a professional) recently they came back to me that my I140 got denied due to educational evaluation difference and need to reapply again through a new lawyer as EB3 - unskilled - system support engineer.
Is this really require to go through the new lawyer to restart the GC process? - and this costs me to lose my priority date - almost 2 years
If yes, how are the chances to get the perm/I140 if I reapply through the same H1 company ?
Please find the denial docs and remember that I have to go for H1 extension by Aug'10 ( as I complete 5 years on my H1).

12. Following this trend, there were only eight States
in FY 2009 with over 1,000 certifi ed PERM positions,
and in FY 2009 the number of positions approved in

most signifi cant decreases occurred in California, Texas,
and Illinois, where the number of positions approved
declined over 45 percent from FY 2008. The most
demanded occupational positions in FY 2009 were
found in the Information Technology industry, with the
Advanced Manufacturing and Finance industries also
drawing a large number of position requests.

Hi guys,
my friend's situation is like this
1) EB2 is approved through spouse and I-485 is pending ....priority date for this is March 2005
in the mean time EB1- 140 is approved.
so my question is
1) can i apply another 485 while the 1st 485 is pending... ?
2) should I go ahed and apply for new 485 with EB1 any suggestion's are welcome.

H1B Transfer is not equal to H1B Renewal.
H1B transfer: when you change your job, you transfer your H1B visa to the new employer.
H1B Renewal: when you stay in the same company for 3 years, you need to file h1B renewal for the 2nd duration of 3 years.

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).
Go out of the country and come back in H1 status, provided you have a valid H1-B. (Can go to Canada also). Otherwise, too many hassles. (non-immigrant vs immigrant intent)

Hi,
I need some urgent advise. My wife has got a Biometrics appointment notice for 8th Jan. She is in India currently and scheduled to return on 24th Jan. We have already got the appointment rescheduled once (original notice was for 1st Dec). When we got it rescheduled we asked them to give us the next appointment after 1stFeb, but they ignored that part!
I wanted to know can I get it rescheduled again? Will it have any impact on her 485 application? Do I need to enclose any cover letter explaining why i need to reschedule? Any personal experiences with rescheduling the appointment more than once?

On April 15, 2010, the Department of Homeland Security issued the USCIS �Annual Report on Characteristics of Specialty Occupation Workers (H-1B) for Fiscal Year 2009.� The summary reports on information including the countries of origin, occupations, education levels, and compensation paid to those who had approved H-1B petitions in FY 2009. The report includes the following facts: approximately 48 percent of all H-1B approved workers were born in India; 41 percent were for workers in computer-related occupations; and 41 percent were for workers with a bachelor�s degree and 40 percent had a master�s degree. Ok. After my lawyers call, they corrected her name. The "a" is still missing from my name though. She thinks it won't be a problem at the port of entry.Hope she is right
