Considering many limitations to move a job from non-profit to for-profit, I am considering moving my job to another non profit. With my current employer, my 6 year H-1 B will expire by the end of next year April. So if my change my employer, I will have a very short time to start the process again till I reach I -140 approval again with the new employer.
I heard that from non-profit to for-profit, you are subject to the quota and you have to apply for H-1B quota. But in this case, your previous 6 year with non profit doesn't count.
But if I move from non-profit to non-profit, do I have to reach I-140 approval before my current H-1 B with my current employer expires? Or do I just get another 3 year with new non-profit employer?
If I have to get I-140 approval with new non-profit employer before my current 6 year H-1 B expires, is it doable?

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card

I am from California. One of the requirement as you all know is Notice of Job posting with SWA. We have a new person in our HR who deals with immigration the earlier one left .
Problem Description: According to our new HR posting jobs on http://www.caljobs.ca.gov/
is equivalent to Notice of Job posting. Can anyone from California confirm if that is true. If there is additional method can you provide the details or any link.

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).

I want to that till how much time is the petition valid , if I dont go for stamping.
Also , suppose my company withdraws the petition, so now till how much duration my cap number is valid?
Expiration date will be mentioned on I-797 approval notice
you will be counted only once against cap. and you can be on H1/L1 for total of 6 years (without a break) - ofcourse assumption is that you never file for a GC

My spouse is out of country and she cannot comeback immediately since we are waiting for my H1 extension approval. Taking visa appointment days and airline availability in to consideration, she may not be able to make it back before end of july. I heard you can always add spouse later while 485 is still in progress. What are the implications if I go this path ?

Massachusetts Republcian Scott Brown's web site has a pretty harsh position paper on immigration - the typical tea party-esque xenophobia one expects from the far right. All about enforcement and nothing about dealing with the millions of immigrants currently hear without status (other than deporting them all) or reforming our broken legal immigration system. Brown has been portraying himself as a moderate, but those in the Bay State who consider themselves pro-immigration should pay heed. Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?
