The reversal that they are talking about is the July02 bulletin that said that they will not be accepting any applications as for the bulletin that came out in June for the Month of July (where the PD's were current). Nothing to worry about. Relax and continue with your filings. :)

Can anyone tell me if a PERM is first audited, and then reaudited, which one will be used for the priority date? the first one or the second one? or it does not matter (based on the date when the PERM was first filed)?

TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?
Means, they reviewd all cases wherever the VISA dates were allocated/available. As you are from India, you have thousands of cases ahead of you.

What are the options when labor is being audited?
- Know the reason for audit
- Start a new process and make sure all the reasons from audit are covered under the new process
- When ready to file PERM, withdraw the old application and file a new PERM case
If you are not audited again, you will get the approval in less than 2 months.

New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

My wife is planning to travel overseas for 3 months and return on AP. Her status is AoS(dependent) as she quit working on H1 a few months ago. Any experience using AP for such long stays outside the country? Please share your experiences.

Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.

Hello Attorney,
I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case.
