Hello everyone,
My questions are about F1 to H1b change status.
I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?
3. In my situation, what should I do right now? Do I need to find a school to keep my F1 visa? When is the best time to find a school?
4. Can I transfer H1b to another company during my H1b is pending?
I am very appreciate if you can answer these questions. :)

I am trying to apply my AP (I-131) renewal. My current AP will expire on Oct 17 2009.
I had few questions about the form. Can someone please help me with the answers of my questions?
Part 1
Q#3. Class of Admission: I used my AP to enter the country on Sep 7th 2009. I am currently working on EAD. What should I enter for this field?
Part 3
Q1. Date of Intended Departure: I do not have any trip planned right now. What should I enter for this question.
Q2. Expected Length of Trip: What should I enter for this question?
On Part 7 it says that
"On a separate sheet of paper explain how you qualify for an advance parole document, and what circumstances warrant issuance of advance parole."
Can someone please let me know what needs to be done for the above?
Thanks
Sudipta

An interesting Q&A article on CNN Money about where tech. jobs are:
Where tech jobs are now, and the skills you need to get them - Jul. 21, 2009 (http://money.cnn.com/2009/07/21/technology/tech.jobs.fortune/index.htm?postversion=2009072114)
Funny you should ask. CompTIA, the biggest trade association for IT folks and their employers, recently launched a new recruiting campaign aimed at filling an estimated 400,000 tech job openings.
Still, "before the recession, it was 700,000," says Todd Thibodeaux, CompTIA's CEO.
With so many people looking for work, why are so many jobs going begging? The short answer: A scarcity of candidates with the skills, or combinations of skills and credentials, that employers want.
Unemployment among tech workers stands at about 4.9%, far lower than the 9.6% overall U.S. jobless rate
--------------------
If this a current reality even in this recession, why are people targeting hard working, law-biding, peaceful, tax-paying, revenue/job generating, and community helping keep US technology leadership ??

Over more than the last 30 years, Ive advised countless foreign businesses and investors seeking to establish operations in the United States. Many thrived, but some, regrettably, failed to survive. Often, the founders inattentiveness to the requirements of U.S. immigration law has been a primary cause of rough beginnings or failures to launch. This blog post will offer best immigration practices and identify traps to avoid when a foreign firm or individual plans to start a business in America. 1. Respect the Law Its Not a Game. The U.S. is no doubt the world leader when it comes to...

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.
Thanks

From a press release from the New Orleans Workers' Center for Racial Justice: Secretary of Homeland Security Janet Napolitano has dispatched her top detention advisor to Basile, Louisiana to meet with detainees who have monitored conditions and staged hunger strikes in the isolated ICE detention center during the last month. Dora Schriro, Director of the newly created Office of Detention Policy and Planning, is on her way to the South Louisiana Corrections Center now. Meanwhile, detainee Edgar Nelson Bojorge Alcantara entered his sixth day on hunger strike today. He and other detainees in the facility have held five hunger strikes...

Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.
Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved
If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?
Thanks,
Sirisha

Hi,
My current H1 is valid till Feb 15 2010. My lawyer filed for H1 extension in Aug 2009, almost 6 months before the visa expiration date.
After 3 months my lawyer filed an enquiry with the CIS and CIS responded back saying they had sent an RFE on Dec 16th 2009 to my employer. However, my employer hasn't received any mail from CIS. Then my lawyer requested the CIS to send another copy of the RFE on Dec 30th 2009.
However, till date nothing has been received in the mail. Is there any way I can get to know what RFE has been issued by CIS?
It has been 6 months since filing my extension at CIS CSC and uptil now there is no news. Can CIS get any worse when it comes to H1 extensions..I don't think so.

Hi Folks,
Anyone have any experience with or knowledge about filing a 7th year H1-B extension per AC21 106(a) when labor certification was filed under PERM more than 365 days ago and the I-140 has NOT been filed / approved yet? There is a 12/27/2005 USCIS memo says "Guidance on this subject will be provided in a seperate memorandum", but then there is no seperate memorandum (that I could find).
My lawyers are telling me I can't file for a 7th year extension because I filed for LC under PERM, but after researching the matter, I am pretty sure they are mistaken. First, the language of AC21 states "the filing of a labor certification application on the aliens behalf"... no distinction between ETA 750 (Traditional LC) or ETA 9089 (PERM). Furthermore, I've read various accounts on the web that state USCIS is in fact approving 7th year AC21 106(a) extensions based on PERM, but I haven't had anyone confirm that they actually did this or know first hand of someone who did.
Any help would be greatly appreciated !

Hi All - Our priority date is current since the last Bulletin. We contacted our Senator last week for our cases. They just called us back and said that our file is at National Records Center...(not National Benefit's center). They also said that usually the cases that have been approved go there. But we do not have any approval through email or online. Info pass appoinment also did not help.
Has anybody else's case got transferred to National Records Center ?
Thanks,

I just got my H1 visa. As my understanding that they will stamp my passport at the port of entry, I wonder if they will keep my current I-797 at the port of entry (I already have the H1 stamp in my passport). Pls advise. Also, I dont have the bottom portion of the I-94 on I-797 since I am currently in Malaysia . Would this be a problem? Please also advise if they will issue me the new I-94 at the port of entry. Anybody pls help. Thank you very much.

if filed I think your att. may use PD portability.
If not filed, don't see any reason why he can't straight use the LC of 2003.
Ask him. Search here at IV on PD portability.
