I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Hello Gurus,
Please let me know where can I book an appointment for H1B visa extension stamping in Canada and/or Mexico.
Also if you have recently been there for stamping then please share your experience.

Two friends of mine were in the same situation.
In both cases dependent children were approved first, then primary applicant
(in one case in a 6 month after his dependent)

Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.
Will the dates retrogress by then? Please advise me folks.

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. My spouse is on H4 currently. Have applied for H1 in April 2007 and got the H1 aproved. So the new H1 starts on Oct 2007. However, we applied for 485 and got our EAD's (No recept number, No finger printing etc).
Can my spouse use EAD to start job? we dont want use that new H1 currently. What are the implications if we use EAD? Will the H1 (and my H1) be effected?

Even when officers work on your files, there may not be any LUDs.
If you input all your case numbers (old H1B approvals etc), you will see that those get LUDs once in a while. They may be batch jobs or someone pulling files frequently or filing old applications etc.
Since your PD is a few months away, it is best to just relax and hope your applications are preadjudicated. When your PD becomes current, then go the Service Request - infopass - senator/ombudsman route.
If you are that interested, take infopass appointments and find out where your application is. If the CIS person is friendly, they give out a lot of information. Dress well and talk politely.

The case status online shows her EAD application was received and pending. So on Jan 24th we put a Service Request for her EAD application. Yesterday we received a letter from USCIS with the following information --
The status ofthis service request is:
WAC-XX-XXX-XXXXX
Your 1-765 application was administratively closed on 0112912008.
If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.
If anyone has similar experience or know why they would close a case without giving any information or RFE/NOID etc? I tried calling them but the IO couldn't provide any further info.

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?
Given a situation, one way to dust a file is to send the medical with a cover letter.
