I had gone thru a layoff experience 3 years back.
They laid my team off in April, but for some reason said that they will keep us on payroll till July (effectively we got a paid holiday for 3 months :-) ) and gave us severance on top of that.
I took the 3 months to do job search and started the new job in July (technically there was a month gap between when I stopped being on payroll and when I started new job).
Recently when I asked old employer for employment verif letter for I140, the letter said I was employed till July of 04.
In general my feeling is, as long as you have paystubs and employment verif letters that you can use to claim you were employed till a certain date, you should be ok.
How much of a grace period on top of that USCIS gives is a hard qn to answer (just like anything else related to USCIS) ?

Fragomen applied for my PERM application last year. The rule is - either advertisement start date or end date should fall in "wage survey duration of 3 months". They didn't follow that. And my PERM got denied. Immediately they applied for my PERM. And it's stuck in Audit. And not to mention, even though it was their mistake, they took fees from employer for filing 2nd PERM.. saying DOL wasn's clear about this rule, and never rejected any application before for this reason.. So its not their mistake!!

I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. I applied for my labor during sept 2002.Just before my labor getting cleared, they started this BEC 's and sent my application to PBEC and it it was cleared during 2006 April.( after 3 and 1/2 years)
During this period I got one year of extension for my H1B and sent papers to the attorney for I-140.That stupid attorney did not file my I-140 for the next 4 months just like that.( god only knows what happened bw, my employer and attorney). and at last we changed the attorney and applied for I-140 during 2006 November. and during 2007 Feb I put my I-140 for premium processing.
Before I get RFE for the premium processing , the USCIS mistook my employer name with other employer and denied my I-140.And again After the attorney clarified them about the RFE , they Put my I-140 into Abeyance state. That means I can not File for I-485 because my I-140 is not in pending state and I can not apply for I-140 again becuase I-140 is not in denied state.
And for the past 3 months My I-140 is in neither pending , nor Denied state and my attorney does not even answer for the question whether I can Apply for the H1B extension.

excuse my unfamiliarity with the process..
but if I applied for I485 in July, and 485 applications they receive exceeds the visa numbers available for July, what happens? Do they draw lottery to see which 485 apps would be cosidered?
in other words, just making sure the app reaches USCIS in july first wekk, does it guarantee EAD for spouses?

Additionally, I will continue to support programs like E-verify that provide employers with tools to verify whether or not current and prospective employees are legally allowed to work in the U.S. Since its inception in 1996, the E-Verify program has provided employers with a process to verify the work eligibility of new hires. E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.
On July 8, 2009, the Senate passed H.R. 2892, the "Department of Homeland Security Appropriations Act, 2010." Included in this bill was an amendment, offered by Senator Sessions, which removed the sunset date on the E-Verify program, and requires federal contractors to participate in the E-Verify program. It all depends on the number of people on EB3 for each month from Nov 2001 to date. Since dont have the slightest idea, there is little we can do. if you can switch, go ahead and switch. Its no use speculating, data doesnt tell anything because sample size on that site is very small and the data is not up to date.
if an EB 3 switches to EB 2 is the visa deducted from the EB 2 quota or EB3 or both, i guess it should be EB2 ... considering USCIS..who knows.

There is no statutory requirement on wait time. You may not even be an employee when your future employer files for your PERM as green card is for future job.

Still puzzled and wondering why they would ask about PD.
Is this something we have to fill out on the AOS application?
I know it is not always the labor filing date, it can be the I-140 filing date if someone didn't require labor cert.
But, do we fill this date out on 485 app and is it entered into their system?

innovation, U.S. employers must have access to much-needed and sought-after highly educated talent �
including scientists, researchers, teachers and medical professionals. Foreign-born professionals make
great contributions to the U.S. economy and create good, high-paying jobs for all Americans.
U.S. employers rely on EB green cards to keep foreign-born talent living, working and innovating in
America. Yet, despite the critical importance of these visas, Congress has failed to address the well
documented backlogs in the EB green card system that leave some foreign-born, highly educated
professionals waiting over six to 10 years to receive a permanent resident visa.
The three bills will address many shortcomings in the EB green card system. For example:
� H.R. 6039, by exempting highly educated, foreign-born students earning an advanced degree in
science, technology, engineering or mathematics from a U.S. university from the annual EB green
card limit, would help U.S. employers retain these talented individuals in the U.S. workforce. For
example, foreign nationals comprise half of the master�s and 70 percent of the Ph.D.s in electrical
engineering from U.S. universities.
� H.R. 5921 will help put an end to multi-year wait times by eliminating unduly restrictive per
country limits on EB green cards.
� H.R. 5882 will help to reduce visa backlogs by �recapturing� EB green cards from prior years
that went unused due to government processing delays and making them available immediately to

This is excellent news and we should step back and celebrate for a moment, however we need to concentrate on IV goals.
