Hi,
My EAD got expired in July and I got the Denial Notice of the H1B petition last week. My lawyer thinks it's got rejected because of my salary change and address change. So she's going to file a new H1B petition on a nunc pro tunc basis. What is nunc pro tunc? Is my case eligible to file such a petition?
And if not, what other options do I have?
Please give me some advice, any advice you think might work. Thanks!

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. The obvious monumental effort Ms. Bernstein put in to bringing this story will also likely move her on to the short list for a Pulitzer Prize for this hard-hitting piece of journalism.

I have one question: My I-485 applcation (employment based) was rejected due to I-130 attachment in error.
If USCIS reject my entire package of I-485 because I have attached I-130 application. What are my options? Is there any law that USCIS can only reject I-130 and accept I-485 appplications (myself and for my wife)? I have seperate fee checks for all the applications.
Please help me....

Hi,
Does 5% salary reduction require an amendment even though the salary is still much higher than the prevailing wage? I have been on a reduced salary for a year and about to get a visa stamp. Everybody says something different on this issue. I am just worried that this will cause problems in the consulate. I don't even know how the consular officers actually figure someones annual salary from their pay stubs. Should i just go and act like everything is normal and not mention about the reduction? Because it makes such a little difference in every paycheck. Please help me out on this issue. Nobody responded my previous post. I am very stressed out.

I have been on H1 for the last 8 years. My most recent H1B was expiring in July 09 and my company had filed for an extension in June. Unfortunately, there was an RFE. When going through the RFE response, our attorney identified another mistake in the petition and believed the best action was to withdraw it and file a new H1 extension petition. The RFE 'respond by' date has also passed now. Since my previous H1 has expired, would this new H1 Extension petition be considered a valid one? I have my EAD and can continue to work on that till this H1 is approved. Please offer any suggestions you may have and let me know if there is anything else I can do.

Can some one still continue working on L1 or one must have to surrender L1 and need to switch over to H1.

George W. Bush has been the most accommodating of presidents. He has rarely used his veto pen to kill legislation. Until now.
Last week, Bush vetoed a bill that would have expanded federally funded embryonic stem-cell research. He said scientific advances allow researchers to pursue lifesaving work without destroying human embryos. It was his third veto ever.
But there will soon be more. Lots more, and almost every one of them will have an impact on the markets and business growth.
Bush has attacked the opposition party for "excessive spending" and has vowed to veto many of Congress's 12 appropriations bills, which are on track to exceed his wishes by $23 billion in the next fiscal year.
In response, some Democrats have said they can play that game, too. A faction thinks the last thing they should do is let pass almost any legislative initiative Bush and his party can claim credit for, including the immigration and energy bills Congress is working on.
These confrontations are shortsighted no matter who's to blame. A budget impasse would depress markets and weaken the dollar. Failure of the immigration bill would threaten businesses that hire illegal immigrants with increased sanctions or compel them to hire fewer people, either of which would lead to higher prices. And energy shortages could easily become chronic unless more is done to reduce our reliance on high-price oil.
Shallow political finger-pointing is not an adequate response.

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:

Hi All,
My employer has filed for ETA 9089 and it is approved. I am paying for the green card processing. Before applying for I-140 he asked me to sign a memorandum which states that I am bearing the complete expenses of the process (filing fees of I-140 , I-485 and $500 extra) . It also states that I need to be with the company for 6 months from the time green card is approved. In case I leave the company prior to 6 months for whatsoever reason, I need to pay $15000 as damaging charges to company.
He says that signing this memorandum is mandatory otherwise he will not file I-140.
My questions is , Is it legal to bind an employee to these conditions and ask processing fee to file Green card ? Also are these documents valid from legal perspective ?
Please let me know your thoughts on this. Appreciate it.

off the Topic! Sorry. Wondering if any IVian has good idea about itemized deductions we can take while working on 1099-MISC instead of on W-2? There might be good chunk of Spouses working on 1099 in IT or other areas of expertise while working on EAD.what kind of expenses where we need to save receipts while filing Taxes later on in '09.

Technically, You AOS application provides you status. So, unlike on H1b, you can be without a job for a long strech of time. The problem arrives, when there is an REF on your I-485 application to show proof of offer. If you can show proof of employment, you should be fine. But, There is a possiblity that USCIS might ask you for recent paystubs or W2s. So, I wouldnt be without a job for too long.
At least this is my understanding of it. Anyone differing from this opinion?
