Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
I am also like you. As I have been searching this forum, I understand that you can ask your new employer to process a new EB-2 PERM, once it is approved, the new employer can submit for I-140 with interfiling of old PD of EB-3.

I think we can wait till Aug 15th for I-140 receipt and if we don't get that (:( :mad: :confused: ) then we can file I-485 with the mailroom instructions from the FAQ (:) :) )
but its better to wait till Aug 12 not more than that.....

Can you please provide the reference through whom you applied? I thought 0213 category is not eligible anymore.

This proposal outlines a framework of policy recommendations aimed at restoring security at our borders, cracking down on employers hiring illegal immigrants through an employment verification system, and establishing a strictly regulated system for earning legal permanent residency. To ensure enforcement, the framework also calls for increased border patrol personnel, resources, and technology, and lays out a policy for administering temporary work and student visas.
The framework for comprehensive immigration reform has not yet been introduced as legislation in the Senate. Please know that I will continue to monitor the status of this proposed framework, and I will keep your views in mind when the Senate takes up immigration reform.

Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!

Can someone explain me how can i find a H1b is new or transferred?
I got all my H1B photocopies. Does it(new or transferred) show on H1B Document?

If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).

They are cheap compare to other airlines and if you travel from JFK,there is direct flight to Mumbai, it will take you there in 13 hours, which is really good....offcourse the Air India staff are not professional, I have no right words to explain about them, in a scale 1 to 10, I will not even rate them as '1'........if you miss connection in Mumbai, then you have to struggle like any thing, nobody will help out...no proper plan at all....they feel that they are kings and can do any thing.....not at all customer friendly, If I am the boss for AI, first I will train them how to treat the customers, if they refused to learn, I will fire them.....yes, just firing is the solution.....

I used to work in company A where my I-140 got approved but I was laid off. Now I am with company B in a higher position and pay but B has delayed filing my PERM. As the economy is bad so I am looking to go back to A and file 485 when PD is current. I need to give a copy of H1 for transfer from B to A. Will i be needing the original H1 copy from B at any time as B gave me a copy not the original (weird).

The US Immigration Law is a nightmare.
Couple of years ago, I migrated to Australia.
The Australian laws are very clean and straight forward. There is only one application form with some very simple question and detailed instructions. Just fill up the form, enclose the necessary documents and fees. That's it. You are done. In due time they will let you know "YES" or "NO".
There is no need to feed fat-belly hungry sharks called "Immigration Attorneys" (of course there are exceptions).
Once your case is approved, you and your family are eligible for the all the rights (except Vioting Power) enjoyed by any Australian Citizen.
Once accepted, there is no official discrimination.
Here the US Government cries about anti-discrimination, human rights etc, but those are only eye-wash. They should take lessons from the Australians.

Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?
