Your post is good overall, However I dont think you know how stuff works. I dont think you have any clue how people got stuck in BEC.

So the cases in BEC are not even worked on, hope you understand that there is nothing wring with the applications of people got stuck in BEC and that not the reason why they are in BEC.

Simple e.g. I like Target as a store. That doesn't mean I give Target money and let them give me whatever they want for that money. I want to know before hand what my money is getting me.
very true when you are talking about a person who walks into a store. But you are asking for Target's strategic plans, how many stores it will open in the next quarter, what is their marketing plan in regards to Walmart (their main competitor).

Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

This is for the ones who think that the discrimination based on EB3 or Eb2 is a bigger issue! I would not get into the discussion on why I think that IV is not just about EB2. Also, on our forums it's about reality and not empathy, which everyone should understand.
Now having said that, please direct your energy towards elimination of country limits rather than fighting a fight which was in your past. Why your company put you in EB3 and not EB2 is not something USCIS or US can control anyways. But when you are EB2 or EB3 with same qualification, experience and expertise compared to someone from say Europe, Australia and many other countries but China, India, Mexico and Philippines than why should that other person get it before you do when you applied before him???? What is America getting anything different from this other person?
Now talking about diversity for country limits India is more diverse than any other country in the world! And hey, most of them are already here in the country and waiting in queue, how is this helping the diversity?

The US Immigration Law is a nightmare.
Couple of years ago, I migrated to Australia.
The Australian laws are very clean and straight forward. There is only one application form with some very simple question and detailed instructions. Just fill up the form, enclose the necessary documents and fees. That's it. You are done. In due time they will let you know "YES" or "NO".

If the EB system is categorized by country quota, what is what would be the apparent use of capturing data without the unlerlying country of origin of the applicant?
If the data is truly not available, what system are they using to anticipate demand and inform the DOS?
Based on the reply to this FOIA from Needhelp!, it seems that we have a bigger problem than transparency.
They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability. If you have 500,000 pending cases and dont know how many cases for each country of chargeability, then the only way to respond to a visa bulletin is to go thru all 500,000 cases every month, take a peek in it, look at the PD, look at the country and see if it is up for approval. I dont think they are doing that.
Also, if priority date is something that is different for different countries, then cases for those countries have to be sorted by priority date in different silos, so that when the next bulletin comes, you know how many cases are eligible that month and which ones are the earliest cases (from PD perspective) for each country.

Go_guy when did you come to US, When did you go to Canada (Toronto).Which job are you doing now in Toronto?
I first came in 1999 Fall as MS student. Then in between, I went back to India during the 2002 downturn and then came back in 2005. I did my MBA finance at U of T and now
working as Analyst since my second year ( due to F1 visa restrictions I couldn't have
done that in US). After graduation I am working there but looking for better options as well.
I came as PR in Canada. But i look at the international students from India in U of T. They are far better of than the international students in US. Here they get 3 years work permit
after graduation and can also work part time while studying. With new rules u get PR quickly after 1st year. Also during the 3 year post degree now they are eligible for the government health care like PR/Citizens. Canadian immigration is now highly tailored toward people
studying/working in Canada.
Compared to that, US treats its international students like dogs. If I get the opportunity to relive, one thing that I would not have taken was doing my previous MS in US. Moving to Canada was the smartest decision taken...no regrets.

I've been working with David Frenkel at Frenkel, Heshkowitz, Shafran in NY. Been with him through my H1B process and now my PERM, will continue with him. He seems very knowledgeable. He's a very very busy man though so it's a little difficult to 'talk' to him. The paralegal who worked on my PERM is reason I actually got it done...my employer is very unresponsive.
So overall I think they are good. I have called to ask questions, emailed, gone in for consultations, never charged extra. All a set fee, expensive somewhat, but it's broken in steps, like pre PERM, pre I40 etc...so guess it's almost guaranteed

Pressure from airlines to keep schedule and minimize fuel expense in the form of performance review/rewards/bonuses. Strong captains can resists but the pressure is constant. Not much unlike Health care companies that reward primary physicians that give minimal referrals to specialists. Such doctors are rewarded with free lavish vacation.

I see there are many amendments for the Immigration bill that was currently on the Senate floor Senate floor and as of today it�s been stalled, and probably will be brought back to be debated on. My question to IV core and members are that there are what version of the bill do like or will support.
Because the bill stated that if the point system comes into existence then it will only begin from the next fiscal year 2008 and in the bill it also stated that all I140 files after May 15, 2007 will be NULL and VOID. DO IV and core support this version of the bill, because I don�t and many people out here too don�t support and what role is IV core playing on this matter?
I know the point based GC system will be happily accepted by newcomers who just got into the queue of this GC process but what about those who waited for years to reach this stage to file I140 and then finally coming to know that their I140 is not valid because of the so called new BILL.
I am totally against any new Immigration bill that does not benefit the who are in the queue for years. I wish others too in this forum agree with me.
This is my opinion. You guys can agree or disagree its totally unto you guys. But this is my stand on the Immigration bill and will try my effort to bring it down. Only time will tell.

I was in Indian consulate for renewing the passport. I went there on time and there was a pathetic guy at the entrance who refuse to speak other than hindi. Though I told him that I do not understand hindi, he never listen to that and started his conversation with hindi.
Then comes the worst part. A cab driver went to him and handed over some dollar note and got the token. Then the driver handed over the token to the passenger and left. That guy got into the line well before me and got his work done. @#$K those people.

As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.
According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.
in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law.
For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.

I have a good experience with them. They have filed all my applications without unnecessary delays and they were also proactive in informing me about the visa bulletin reversal at the end of June.
