Hello:
I'm Canadian who've worked in US for the same employer under L1 Blanket for almost 3 years, my current L1B will expire at July 2011. I heard a lot of L1 extension get rejected recently, I wonder if I can have a fresh L1B petition (I-129) with another 2 year, then go to US-Canada border and turn around with the fresh L1B petition, so I can stay in US for anther 2 years.
My only concern is that, do I qualify the '1 year working at foreign branch within 3 years prior to admission to US' requirement? considering I've been in US almost 3 years already.

Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. Friends Hi :
I have one question. Once we receive EAD and all 9 yards notices and once you switch from H1 to EAD system with same employer, are you still bound to work with same employer for full 40 hours.. can you cut your hours to 20 hours (nooo second job too). I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?
Pls. advise me

Restamping is not required. But just make sure you show your new approval notice to IO at POE. Done this couple of years back

Hi All,
I have applied I-485,I-765 and I-131(AP) for my wife as derivative when my priority date(March 26th 2006) became current on September 1st.
We recieved the Reciept notices for I-485,I-765 and I-131(AP) for my wife on September 30th.
My I-485 got approved on 11/05 .We didnot recieve FingerPrint notice still.
I would like to know how much time it generally takes for derivative I-485 approval .

Hi, i have applied my labor application eb3 in 2003 august and got approveed, applied 140 and 485 in july 2007 and i am on EAD
i came to USA on Company A in august 2000 and moved to Company B on 2003 march and applied for green card in EB3
now my company A is willing to apply my gc in EB2 and capture EB3 pd
but my lawyer says if my EB2 gets rejected they may not issue my GC saying that my new job is not same or similar (he says eb3 job which does not require Master is not same as EB2 which requires Master or 5+ years exp)
Company A and Company B are belongs to same management so the compnay is ready to do my EB2, but my lawyer is telling there is lot of risk involved

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?
I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

It has been over two years I got my EAD, and I am also on H1 and my H1 is valid up to May, 2011. Now, if I want to switch to a new employer, I want to know if there are any complications...I read that we can always switch to new employer and can still retain the priority dates. Is it true? What is NOID? Is it possible for the old employer to revoke my I-485? or can they do anything that affects my Green Card status or the legal status in the country?

My H-1B expires next year (after 6 years). I have been here 10 years (on J-1 and then H-1B visa). My employer isn't in a position to apply for Labor Certification, although they want to continue hiring me. I want to stay (no relatives here etc.). I know after one year, I can return on a new H-1B if my employer will petition again but it is messy and I want residency. I am from Britain. Help!!!

Hi,
Need good advice.
My fiancee had an approved post decision status on her H1B application. She's waiting for an interview in the US Embassy for final approval.
We're planning to get married so that she can bring me and our 2 year old son.
My concern is what will we do, will we marry before her interview or after her interview?
Another biggest concern is I have a pending petition from my mother who is US Citizen, I belong to F1 Category. I know that if we'll get married my petition will move to another category which is F3.
So this is a bit confusing whether we will marry before her interview or after her interview?
Please put some inputs. Thank you very much!

I am very sorry to hear about your situation. Yes, you can bring your sister here on a visitor's visa to stay with you but she has to go back in 6 months.

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?
