    The numbers game is really a 6 of one, half a dozen of the other - since we can only best guess it all - as I think this healthy debate has shown!


    Efficiency of processing is a HUGE problem! Why do you think the visa numbers have gone unused? Your statement perplexes me somewhat. The name check isn't the only reason that there are delays. The Ombudsman's 1st 3 annual reports documents where the inefficiencies are.

    In reality, its a complex problem that is a combination of many things;Inefficiencies in processing,Retrogression, country limits etc etc

    Check these numbers from 2000 to 2003.

    They managed to issue 174,968 EB visas, even though the limit was much more.

    The maximum number of visas allowed under the preference system in 2003 was 171,532 for EB immigrants.

    Surprise, they only issued 82,137.

    In this big black hole we are alone, not the govt. nor the lawyers really care for what goes with us. USCIS is just a money making machine for the govt. Rules are made complex and there are several layers of forms. I wonder why a person should go thru 2 stages before filing for I-485. Or why they have 5 different forms filled Labor/I-140/I-485/I-760/I-131 blah blah blah when they could just do it with 1 form like any other country have or may be 2 layers, labor and I-1485. There's no logic of having to file I-140/I-760/I-131. It's all money game...

    AILA does not care about people its an organization to take care of lawyer's interest. When you file every year the lawyer can make money every year. So be rest assured they will make some noises but will not bite USCIS.

    These news are common when anyone is in politics. When some one get sudden familiarity other group try to spoil the name. First they tried that her 5th child is not her child but her daughter's child. She immediately announced that her daughter is 5 months pregenant. After that they started that she has immoral relationship. It may be or may not be true. But until it becomes true she may be considered as good wife and Mother.She is inexperienced that is true but if we consider that Obama also inexperienced. So it is just selecton of better evil. But Politicians here is much better transparency,less corrupt,better skilled than majority of countries in the World.

    Just to add, Not sure if this is true but there is news that Sarah Palin cheated on her husband, and had a relationship with the business partner of her husband. She is not a good mother, not a good wife, cunning & opportunist politician, with very little experience and a heartbeat away from her finger on the nuclear button when she is ready to go to war with Russia. Watch some 'Sarah Palin' youtube videos and see for yourself.

    Now please don't call this "deep sexism", did anyone see Dick Morris around?

    There is something about politicians who cannot pronounce the word "nuclear" properly. They all seem to somehow become Presidents. Maybe we should start pronouncing the word "nuclear" differently, it may help us to us to become president. :D

    I agree, India is a far better option.

    Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.

    On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.

    As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

    No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.

    India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

    I have much better lifestyle and opportunities than Canada or even western europe! Period.

    Our current situation is dire. Even a back of the envelop calculation of wait times for a lot of us seems unreal. Being inactive in the only organization that speaks in our voice is just not being smart. We cannot let laziness take over and live in denial of the immigration mess.

    For the members who do not want to volunteer for IV activities, the least you can do is contribute to the IV funds.

    I have flown only once via AF from Detroit to Blore via paris. Eventhough at Paris I did not have any problem, the flight exp was horrible. The food portions were really small and they did not give any extras. I literally starved till I reached Blr. On my way back, I carried food from home for the flight. I have never traveled on AF since. I think we need to take a pledge not to travel on AF ever. Lufthansa is no better. The Frankfurt terminal for flights to Asian countries is despicable, but on the way back they have fancy lounges.

    I am waiting for more flights from Jet and Kingfisher which would make travel more enjoyable.

    Air India is variable service sometimes really good and sometimes really bad. But the food is always good.

    To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly and I apologize for that. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

    To sri1309, I never meant to digress from existing items on IV's agenda. All I am saying is that the backlog might get cleaned up a bit if we are able to assist in weeding out fraud cases.

    Commercial airlines fly between 25,000 ft and 40,000 ft. Airlines generally take risks for profits. I know it. Some airlines like United are ultra sensitive to turbulence. Some fly right through turbulence. And sometimes I feel some pilots are plain incompetent, they have no control over aircraft during the storm.

    I have personally taken 500+ flights, almost 2 every week. And I can say, I get really nervous when turbulence or strong clouds are present. You are one second away from the big one. Always always wear seat belt during turbulence, if it gets severe, you will hit the head on the ceiling. The turbulence during take off and landing is usually more risky as aircraft is closer to ground and can not afford to lose altitude. If it is at a higher altitude, aircraft can lose some altitude, due to "air pockets" and still be ok.

    They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

    Well.. :) Look at it from the positive side. It may also mean that your I-485 application is going to take less than a year to approve. (According to USCIS, 2-year EADs are going to be issued only to applicant whose I-485 approval is expected to take a very long time, e.g. more than a year.)

    I have never lived in Canada but married to a Canadian citizen so I am writing this with her help and with my limited knowledge. I don't think 50K per year is enough, you may survive but living standard won't be as good, say, compared to Texas (if you are in CA then its different comparison). You pay more taxes, high insurance premiums, clothes are expensive etc. everything is higher. As per my bro-in-law, the sale price of houses in Houston is less that the cost of building house in Toronto (he is a financial consultant in Toronto). I heard socially Canada is better than US and have nicer people.

    Heath care is free (not dental, vision etc.) but you eventually pay more taxes for that so if you are planning to bring your parents this could be good but for healthy young family basically you pay more taxes for health of others. Health care can be compared to US but not as good because there is cap on doctor's income (300K??) and many good doctors move to US.

    TN is definitely good and hopefully it will remain for Canadian citizens and can be renewed with no cap for maximum years but but your dependents can not work with your TN visa.

    I, myself, have applied for Canadian PR and should get it soon but that's just as stand by and won't move there unless I have to.

    Yes what you are saying is true. I am not denying that but how long can you stay on
    H1B is the question. But yes I also started with 50k but I am moving up. IT salaries are higher. I know banks paying 70K and going even more above 80K. You can also work as independent contractor type unlike H1B. No middle men inbetween and all expenses before tax.
    Yes ofcourse US is a far bigger economy. But I was born in India, what can I do. Within my contraints I am looking for best possibility.

    Since your wife is Canadian citizen, basically your downside risk in US is hedged. If things don't work out you can quickly move to Canada. But for others with Indian passport
    it is not so. Like I said before I am not against working in US under TN1 or H1B. Just that
    I am willing to work under desperate body shopper slave like conditions. If I get position under direct client in H1B its fine with me. In fact when your company knows that you are not that desperate they also treat you differently. Is your wife also born in Canada, if so then it is even beter, you are out of the EB-I trap. You should definiately look for US options.

    Long back when we were working under H1B/OPT for a company in US, there was the annual bonus/promotion announcement. And I saw that none (except 1) of the H1Bs got a promotion. Just one H1B got promotion and that person had recent married a US citizen. Basically the company knew that its leverage over him is gone and in order to retain him they need to promote him. It is all a zero sum game my friend.

    I totally get where you're coming from - I was in the same place also some time back. And I absolutely support dissenting voices - every organization needs a conscience. IV is no exception. So go ahead with your questions and ignore the folks trying to shut you up.

    Heres why I contribute to IV -

    IMHO the biggest role IV is playing right now is educating the media, politicians, administrators etc. about the hardships we're going through. The first step towards solving a problem is to get people to acknowledge there is one. And right now there are people in the administration who don't think or even know there is a problem.

    Mark Bartosik's done some great work with the media. Nixtor has also been prominent here. I'm sure there are others also involved.

    As for the monetary aspect - if we're sitting here typing and other folks are using their weekends/ days off work to get somewhere to make a difference to our fight, I'd see the easiest way of pitching in with money - for printing a glossy flier, or, maybe the cost of an air ticket, or lunch or whatever.

    If some part of the contributions make life easier for these folks - its absolutely worth it, isn't it?

    And for folks who refer to this as "Donation"
    Its not a donation - its a contribution.

    Donation refers to a gift to a charitable organization whereas a ontribution is generally associated with a gift to a common fund or collection.


    I hope this helps you somewhat to get over the hurdle of moving from a member to a contributor.

    As for "donor" forums - think of them as a paid subscription (like shareware ;)). Its also one way of ensuring that anti-immigrant trolls don't get through. I do totally support this model.


    I know this is probably asking for trouble but no movement can be credible without listening to the dissenting voices. So here is my gripe ... You cannot open a single thread or forum without being asked for contributions these days. People are told that if they dont contribute, they are not "supporting the cause".

    But the stark reality is this... If you look at the IV website to see what action/progress has been made in "the cause"....there is some vague statement about Patton Boggs and how we have this lobbyist who is educating congressmen...Who exactly? How? When? Oh those details cannot be given.

    There is a link about IV in the news...the last time IV was in the news was in Sept 2007 ...19 MONTHS AGO...
    Then there is a link about IV and FBI namechecks...The last update is some thread in Feb 08 and this brilliant statement from 2007 ..."IV has met officials from agencies and has raised this issue in the recent past. We have been informed that there is an effort being undertaken to significantly reduce name check backlogs in the next 6 months." SERIOUSLY?? You really expect that you can convince people to contribute based on this flimsy evidence of doing "something" that you really cant tell us ??

    For those asking for money, THERE HAS NOT BEEN A SINGLE UPDATE ON ANY PROGRESS SPECIFICALLY ACHIEVED BY IV IN THE LAST YEAR AND HALF !!!

    How can you justify this? Actually, you dont have to....There are many like me who will answer questions of panicked people about how to navigate the complex immigration system but until IV can provide some concrete proof of what specifically it is doing, how exactly it is spending the money and what roadmap of progress it hopes to achieve and whether it is on its way to achieving it....the money wells will continue to be dry.

    And this new caste system of the DONOR forum which basically says screw you to everyone who has spent time, money or effort on IV and completely goes against the "Change for fairness and Justice" mumbo jumbo is a step in the right direction, IV needs to give way to an actual movement that actually does something and this DONOR forum concept will certainly go a long way in the marginalization of this site and community.

    As I mentioned earlier, it is a simple RFE. In addition, Desi has backedup his suggestion with the proof - Just ask your attorney to respond to the RFE. Post back when you get updates, it will help IV community, who are in similar situation and also the members who do not have a proper understanding of statuses.:D

    Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.


    Ok, firstly, if you are really honest about your feelings, no one is really happy for another unless what the other has done is useful to you. You can wax your eloquence with claims to contrary, but you know it is true. So stop this pretensions.


    Ok, you want a constructive suggestion? Rat on everyone who is doing fake jobs, is a body-shopee, bought his GC etc. That should get rid of at least 20-30% (conservative numbers). How many will support it? I guess not many.

    How about asking USCIS to make the priority date of the substituted applications to be the day 140 is filed? Any takers there? I guess not.

    And then people have the gall to tell us to be happy for Eb2ers, and that we are jealous.


    PS: I realize that substitution is no longer possible, I mean to ask USCIS to retroactively apply the priority dates for such cases.
