and other IL immigration related events, people from the chapter say that they will show up. But they will not. They do not even have the courtesy later to tell that they had something important to justify their absence. This is what ticks off leaders who are working hard.
If you say you are coming to an event and are unable to do so, either inform asap or after the event, have courtesy to send an email explaining why.

Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
Does someone has answer for this?
If your job profile demands seniority (which it must be - going by your EB3-2003 PD), you are better off refiling under EB2, instead of *just* (read just) spending couple of thousands on IV campaigns and beating up on people who are not contributing as much you have done to IV. That is not to say we stop contributing for the general cause. Don't misunderstand and start flaming at me, won't do any good.
I have not done this myself with the same employer, I changed my employer for a senior job position and I had also acquired a masters degree in comp engg from a reputed university before I became eligibile for EB2. But as a fellow IVian, who understands the EB3-I issue, I would surely advocate this not only to you but to all other EB3's with older PDs.

I have no problem with IV. I enjoy this forum and I really liked the that they did the rally last year and the flower campaign. I would like to do something about this whole situation (see my idea for The Two Cents Campaign (http://immigrationvoice.org/forum/showthread.php?t=24962)). I just have problems parting with money :) without knowing what I'll get.

Hi,
Please help me with my situation below:
1) Got laid off from company A (they haven't cancelled my H1).
2) Got my H1B transferred to company B (this H1B transfer has not yet been approved). I did not work for them.
3) I did premium processing for H1B transfer for company C and got it approved. I haven't started working for them.
4) Now I have decided to work for company D. They are ready to do my H1B transfer.
Will that be a problem or do I have to go with company C? I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.

bring all the material and pointers to kick off the meeting. We clearly see you as our technical leader. Formalities will be quick at the meeting so that we can recognize a few people as leaders, who can communicate with IV leaders and keep working on local plans...

Don't take me the wrong way, these guys sure are very nice, but just because he filed in July without a receipt does NOT mean anything. It's not like his 485 has been approved, and even if it had, that doesn't mean anything either.
Remember we are dealing with some contractors in the mail room, and without official guidance from USCIS in the form of a field notice, each employee in the mail room could make his arbitrary decisions.
So, i wouldn't delude myself based on what someone in IV core has done. It MAY sound logical to include the copy of 140 but then as you probably know by know, logic does not apply here :D

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?

Here's what they got that we don't
1) Numbers - 12 million new voters indebted to them for life, is too hard for some national-level politicians to resist
- We are barely 1 million. Given we are "highly-skilled" most of us never likely to vote in elections (to avoid jury duties)
2) Strong support from US Citizens who vote for ethnic reasons. Whether anyone likes it or not legalization of "undocumented" has become a ethnic issue. More powerful than our international/global approach, because there are 25% of US population belong to that ethnicity ( and they also vote in greater percentages than the natives)
- Chinese/Indian/Phillipino/others USC/LPRs communities are miniscule in number. And most of them don't give a you-know-what.
3) They have the strongest Motivator - FEAR - it's a matter of 'survival' and not just pursuit of happiness like us. God forbid, we go back to our countries we won't starve there. These guys don't have any jobs in their countries and will be living in abject poverty . They risk death in the desert, whenever they go for vacation back home. Cops, criminals, USCIS, abusive Employers, Nativists - everyones at their back. Some of them are married to US citizens/LPRs. They face the prospects of getting separated from their families.
- We don't have such a strong motivation. If let's say there was a NumbersUSA sponsored bill to bring all legal immigration down to 50,000, believe me, DC would've been swamped by protesters. We may have met, even exceed initial projection of 10,000 participants. You'd have seen a true multi-ethnic protest respresented by every nation on the Atlas.
4) Money is not a problem for them. Many of them are paid off the books and have never paid Income Tax, SS Tax etc. There are also very strong political organizations, PACs (Political Action Committees) supporting. There are many USCs/LPRs contributing to election campaigns on their behalf.
- We pay all taxes. There is no PAC supporting the cause of EB immigrants exclusively ( ImmigrantsList is a PAC that supports all immigration including "undocumented").
Unless a LPR starts a PAC ( Aman?) starts collecting funds from other former-IV LPRs and US citizens and starts campaign contributions we continue to have a limited voice ( paying a Congressmans election campaign is will catch his/her attention more than paying a lobbyist to talk to them)
So it's not them having many negatives. It's us EB immigrants who face the strongest odds.
Just an analogy please dont think i am against undocumented fellows.. They are definitely facing a bigger problem than us!

I understand the need to gain grassroots strength, But at the same time I expect that IV core members to do better than arbitrary curt responses directing everyone to state chapter on this forum.
I am sure IV core do better, like for example, well crafted sticky memo explaining the need for state chapters/grassroots strength and dangers of remaining only an internet based group of anonymous members and why agenda of the IV will not be discussed or revealed in this forum. There was one good post explaining this.
Such a professional explanation is required to gain the respect of the newcomer on this forum and his views and at the same time promoting IV objectives.
IV and rest of us need each other to get this huge problem fixed.

There's one BIG difference - taxpaying we may be (I hate tax time... !!! :) - we certainly are not Americans yet - not even close.
Though we may enjoy the American way of life, and may have already integrated or have the capability and willingness to do so in this great melting pot of cultures much faster and more transparently than other immigrants (ready with the brickbats... ?) - we're long way from becoming Americans.
Just to set the record straight...

Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.
We can show our protest by sending 1-wish for our own GC ( may be in the form of Christmas tree ornament) to all law makers. Everybody makes a wish and our wish is GC.

If you want some good reasons why H4's should have work permit read this
All these years the United States of America denied work-permits to
dependant visa holders with one simple explanation "You are in USA
because Your Spouse is allowed to work here". But numerous surveys by
different social organizations has thrown light on the darker sides of
the life of dependant visa holders.
The dependant visa holder has to forgo his/her career growth in-order
to stay with the spouse. This causes a big gap in the career and
finding a suitable job in the home country becomes difficult when the
pricipal visa holder has to leave USA and return to the home country.
If the dependant visa holder's field of study or work is, one in which
getting a sponsorship from an employer is difficult, getting a
work-visa is almost impossible. He/she even loses his/her hard earned
skills in the respective fields due to the large gap in career. Even
though volunteering is possible, most of the volunteer jobs might not
utilize the persons skills.
Studying in the USA is good option but, being a single income family,
it will affect the financial satatus of the family if other members of
the family (children) are studying.
90 percent of dependant visa holders are women. Women being, more
susceptible to domestic violence by the partner, becomes even more
prone to violence due to her complete dependance on the Spouse. They
become prisoners in USA due to the spousal abuse and immigration
policies that give their husbands complete control over their lives.
The immigrant Women get protection under VAWA but non-immigrants are
not covered. Even if a law to let the non-immigrant battered women to
obtain work permit is introduced, It might not protect women whose
cases dismissed as non-critical. The abuser can furthur exert his
control over the victim and convince her that he has changed so that
the victim might not press charges against him. Thus the abuser gets
encouraged to continue violence.
Divorce is not an option because most non-immigrants come from third
world countries where a divorced women has to bear the social stigma of
divorce and will not be protected in her own home country.
Because of the long queues for Labor certification applicationa and
retrogression of visa numbers, getting an EAD and Green Card takes
longer.
Most European countries issue work permits to the spouses. Also the
time taken for permanent residency is lesser. In USA L2 and E2 visa
holders can have work permit, but the other categories are ignored.
Fear of flooding the labor market is not a valid reason to deny the
dependant visa holders work permit. Allowing the L2 and E2 category to
work didn't create any marked increase in the unemployment rate among
US Citizens.

I am so sorry that IV did not inform you about Donor forum. I will check with IV on why you were not notified earlier. This is clearly unacceptable. IV core should give up their jobs and should start going door to door to inform everyone about IV's goals, strategies and changes to policies.

All this guy needed to do was to search the forums and read through that thread that I pointed him to, and voila, he would have know what is IV's intention on the donor forum. He probably knew about it but just decided to throw some oil to the fire in this current thread. I agree with your reasoning on giving more focused replies but then that's what I'd keep doing all day because there are tons of folks roaming around here who have nothing better to do but criticize IV!

Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.
I've noticed that it's hard to get someone who can sound like they are really sure of the information they're giving you. I wonder if they're reading from something or just guessing sometimes. i shouldn't have to use the internet to get my information, they should be the #1 information center, and they can't even do that.:(
