Exactly! And thanks for clarifying that, which is what I've been trying to convey for the past 2 days! In your cook example, though, the cook can be self-employed with no income in a given period (week/month)--and he does not need to line up contracts. His business is "legitimate" and is in the same occupation as on his I140 petition. For an RFE-EVL, which he can write on his business "letterhead," all he needs to mention is his "projected" yearly income as salary.
USCIS may not buy if no income shown thro the bussiness. One may have a simple bussiness model. However, they should be in a position to show documentary evidence that they are making similar money as per 140, and importantly they are doing same kind of work when self employed, and they have a long term commitment/contract for their bussiness. Then only they may belief that you are doing legitimate bussiness thro self employment. Just writing EVL in a letter head will not serve the purpose.

EB2-India with May 2005 PD and before : All will be out before May 2010 with some residuals in NC. One thing I am sure, EB2/3-India with PD 2006 and afterwards should not start working on EAD and will have to hold on to H1.
PDs with 2006 and onwards - both for EB2/3 - Unpredictable and scary assuming no change in current immigration policies.

my EAD is still pending. but no lud on EAD cases. just a soft LUD on I-140 on 7/13. Very wired !!

And whatever strategy is formed, it will have blessing of IV and participating member. Please reply for this post. Be serious. I am not joking.
Not only you I need around 100 peoples one weeks time. So other people serious about getting GC, if you are willing to part away your valuable one week time that would be great.
I would like to stress, I am not dying because of GC. But I think we need to do something to get GC. Otherwise, we will be in QUE, a lonnnngggg QUE.

We are making great progress on this and glad to see tonnes of positive responses. For the people who are viewing this thread first time, please send your name, e-mail, ph number and the amount you are willing to contribute ( in case of a lawsuit ) to man-woman-and-gc who is graciously collecting information for us and adding them in the below spreadsheet. I also think green card lottery, chain immigration, and refugee green cards should be eliminated and those visa numbers should be used for employment based immigrants because all these people can immigrate just like us through employment. We contribute more to the American society and should be given priority. I guess when we become American someday, we would like immigrants who contribute to our community too. Isn't that right? :)

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

He has always maintained his legal status and was unfortunate to restart his greencard process several times due to job changes. He did not have a green card at that time and his PD was not very old.

I actually spoke to Customer service and I got 2 very different responses.
1. Wait till you are an old man and then the cards may just come !! (Just Kidding ) she actually said wait for 90 days.
2. Another CSR told me that the TSC is having technical issues and they are not able to access the Biometric information on approved 485's in their systems. She advised me to download Form I-90 from the USCIS site and fill that in and send it in - if you have a minor on the petition then also send 2 passport size pictures of the minor - this will allow them to access the Biometric screen when they process the I-90. We will get Biometric notices and the Minor will get the card - the Grown ups will get the Cards after the Biometrics are uploaded.
I have not done this - eventhough I downloaded the I-90 forms - I took a INFOPASS appt and if they suggest that I should do a I-90 then I can get that done right on the spot - I am carrying the filled I-90 with me. Anyhow I-90 is usually submitted to correct errors on the card or to replace a card - however this woman sounded quite knowledgeable - but then there are issues realted to where the I-90 should be sent - this is specially complicated if your case has been transferred a few times like mine was.
Best is to check with the guys/gals at Infopass -meeting.
All this was from the rep at the TSC - so not sure if this is applicable to all centers.
AGAIN THIS IS WHAT I HEARD FROM THE TSC REP - PLEASE USE THIS INFORMATION AT YOUR OWN RISK - I AM NOT SENDING THE I-90 ON MY OWN.
I will post my Infoapss exp on the 9th of september.
She was rude and did not even give me the chance to speak.
What she told is 'My case is approved and they are missing the Biometrics and I will be getting the mail to appear for the Biometrics'
...and She is not even giving me the chance to explain the scenario of uploading the Biometrics to TSC etc... (I have seen in the forums that for the numbers starting with WAC...Biometrics were uploaded to CSC and the TSC is unable to upload the Biometrics back to their system. And she told him that she will put a request to upload the Biometrics to TSC ASAP which may take 3 to 4 days)
When I tried to tell this, the answer I got is "I don't want to hear anything from you and you will be getting the Biometrics mail as we are missing"

This is my first post here. Even though I've been a member for sometime, I wasn't even aware of these forums. When the July VB fiasco happened, I stumbled upon these forums and I was glued throughout the entire saga. U know what, IV was the only one who gave me any kind of HOPE. I am so thankful for what the IV core has done for us.
Its a shame that we all sit quietly and let someone else pay for our problems. After all, most of us have decent paying jobs here. So I too will pledge $ 100 and I am also going to contribute twds IV's cause.........
I hope more ppl will come forward and do the same.

Its good for the backlog. One way to reduce the backlog if there is no bill is to encourage people to leave USA for 'green grass'. If they leave, we get our green card soon and grass will become green for us.

I am EB3 with PD of Oct 2003. My attorney filed on June first. I will give update as soon as I get the recipet #.
Does any one knows what happened after you apply in Nebraska. Do they send your application to Service center or will be processes all the way through in Nebraska. I live in Texas and my attorney said we must file in Nebraska and can not send to Texas service center any more.

Now, it has happened more than a few occassions that I've come across words that I had no clue about.... and this was one such moment. The dictionary bot came up with a blank face, expressing its helplessness. Looking at the results, I'm assuming you meant "generalizing".... clueless me couldn't figure that out sooner.. :)
Nothing like such amusing moments, thanks to IV, to bring cheer to an otherwise dark & gloomy day (well, mostly... in California a little overcast weather for about half a day can cause the much-feared Seasonal Affective Disorder (http://www.mayoclinic.com/health/seasonal-affective-disorder/DS00195) (SAD) to some... :) )
And those feeling depressed.. perhaps the weather may have something to do with it... ?

Most people here are in IT and have IT friends back home.IITans and IIMs get the best opportunities in India. IT ppl even from ordinary universities have a great future.
But what about others? I have several friends who have a B.S,/ M.S / phd in chemistry, art, sociology, agriculture but have limited opportunities in India. They would love to explore oppotunities in US , Europe or any developed country.
India and other developing nations have other priorities. The government would rather help the poor or improve infrastucture then fund a research project.
