I was under the impression that they send only one notice for each case and that too to the attorney.My attorney has send me a mail that he received the receipt notices and the original would have been sent to the employer.In case the employer has not received,he will send me a copy.
Do i need to have the original receipts.I have a valid L1 stamping and planning to travel early next month.I heard that i need to have atleast receipt notices if i dont have the AP approval by then.

Hi ,
I was in confusing situation,hope you can clarify and help me out.
My wife came to US as H4 in Feb 08.Her i-94 is valid till march 2010.
She applied H1 got H1 approved from Oct08 for 3 years.Since from Oct08 , employer couldnot find project for her.Her employer is asking to move from H1 to H4 back using Cos(i-539).After getting project can move back from H4 to H1 which doesnot come under quota.
My questions are:
1.Is it safe to move from H1 to H4 and back to H1 when she gets project.
2.Her previous H4 i-94 is valid till March 2010.She didnot went to india again.
If she converts from H1 to H4 now,till when she will get i-94(till my H1 valid or original i-94 date).
If she gets i-94 till original i-94 i.e March 2010,does she needs to go to stamping after March 2010 again or continue to be in US even after March or just go for border and get new i-94.
Can you please clarify.
Any suggesstions is really apprecaited.

I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question or suggest any other possibilities for rejection?

Dear All,
I wish you a very happy Diwali and May almighty shower on each one of us, happiness, prosperity and end the woes we face in achieving permanent residency. I truly wish this for each of us. I think when we pray to almighty, we should collectively pray for this cause. Who knows, maybe lord will help us out soon.
This forum has been great to all of us in finding solace, and importantly exchanging knowledge and ideas.
Happy Diwali once again. I know they may delete this thread but I think they shouldn't because many others will offer their good wishes too. Amidst our worries, we should be able to cheer up in the light of Diwali and keep our spirits up and march ahead for another wonderful year.

I am currently on L1 visa and want to apply for H1 through a small-time consulting company. However, I will decide on joining the new company only after I get the H1 visa.
* Is it get H1 visa and not join the company that has filed for my H1?
* Can I legally continue with my current company even after I get my H1?
* Can I join a third company instead of joining the company that has filed for my H1?

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future

I am from California. One of the requirement as you all know is Notice of Job posting with SWA. We have a new person in our HR who deals with immigration the earlier one left .
Problem Description: According to our new HR posting jobs on http://www.caljobs.ca.gov/

I'm surprised no organization is following up with USCIS about the prompt monthly updates on pending Volumes. So much for the push for openess during the 90 day initiative by the President !

While taking a VISA appointment , there is a question which says "Are you applying for same visa class that expired in the last 12 months?"
Here are my doubts
1. I had a H1 B VISA which expired in May 2007 processed by my previous employer. As I am applying for the same VISA class , but though a differnt employer, should the answer be 'YES'?
2. Since my daughter will be appearing for the H4 VISA interview for the FIRST TIME, Is she also eligible to come along with me if I choose "YES" to the question "Are you applying for same visa class that expired in the last 12 months?".
